profes\u00ed je kontakt s prac\u00ed nezbytn\u00fd a z\u00e1rove\u0148 se t\u00edm posiluje mo\u017enost p\u0159iv\u00fdd\u011blku v dob\u011b \u010derp\u00e1n\u00ed rodi\u010dovsk\u00e9 dovolen\u00e9, negativn\u00ed d\u016fsledek m\u016f\u017ee dle d\u016fvodov\u00e9 zpr\u00e1vy nastat v p\u0159\u00edpad\u011b \u010derp\u00e1n\u00ed rodi\u010dovsk\u00e9 dovolen\u00e9 flexibiln\u011b, kdy m\u016f\u017ee fakticky doj\u00edt k obch\u00e1zen\u00ed ustanoven\u00ed o pr\u00e1ci p\u0159es\u010das a o denn\u00edm a t\u00fddenn\u00edm odpo\u010dinku (v p\u0159\u00edpad\u011b souvisl\u00e9ho \u010derp\u00e1n\u00ed rodi\u010dovsk\u00e9 dovolen\u00e9 k obch\u00e1zen\u00ed t\u011bchto ustanoven\u00ed doj\u00edt nem\u016f\u017ee),<\/li>\n<li>novela by m\u011bla zaru\u010dovat n\u00e1vrat rodi\u010d\u016f na <strong>stejnou<\/strong> pracovn\u00ed pozici a <strong>stejn\u00e9 pracovi\u0161t\u011b<\/strong>, pokud se budou vracet z rodi\u010dovsk\u00e9 dovolen\u00e9 p\u0159ed dosa\u017een\u00edm <strong>druh\u00e9ho roku v\u011bku d\u00edt\u011bte <\/strong>(n\u00e1vrh v \u00a7 47 ZP),<\/li>\n<li>zam\u011bstnavatel bude m\u00edt po n\u00e1vratu t\u011bchto pracovn\u00edk\u016f povinnost nab\u00eddnout jim <strong>stejnou pr\u00e1ci na stejn\u00e9m pracovi\u0161ti<\/strong>, v p\u0159\u00edpad\u011b zru\u0161en\u00ed p\u016fvodn\u00ed pracovn\u00ed pozice by pak m\u011bl zam\u011bstnavatel zajistit vhodnou n\u00e1hradu tohoto pracovn\u00edho m\u00edsta podle pracovn\u00ed smlouvy (n\u00e1vrh v \u00a7 47 ZP),<\/li>\n<li>v\u00a0sou\u010dasnosti maj\u00ed matky i otcov\u00e9 vracej\u00edc\u00ed se z rodi\u010dovsk\u00e9 dovolen\u00e9 pouze pr\u00e1vo na p\u0159id\u011blov\u00e1n\u00ed pr\u00e1ce podle pracovn\u00ed smlouvy,<\/li>\n<li>novinkou by tak\u00e9 m\u011blo b\u00fdt, \u017ee p\u0159i zastupov\u00e1n\u00ed za rodi\u010de na mate\u0159sk\u00e9 a rodi\u010dovsk\u00e9 dovolen\u00e9 by neplatilo pravidlo \u201e<strong>2x a dost<\/strong>\u201c, tzn, \u017ee po\u010det opakuj\u00edc\u00edch se pracovn\u00edch pom\u011br\u016f na dobu ur\u010ditou by v\u00a0p\u0159\u00edpad\u011b z\u00e1stupu za MD a RD nebyl omezen\u00fd, jedin\u00e9 omezen\u00ed v\u0161ak bude, \u017ee celkov\u00e1 doba trv\u00e1n\u00ed pracovn\u00edch pom\u011br\u016f na dobu ur\u010ditou mezi t\u00fdmi\u017e smluvn\u00edmi stranami ode dne vzniku prvn\u00edho pracovn\u00edho pom\u011bru na dobu ur\u010ditou <strong>nesm\u00ed p\u0159es\u00e1hnout 9 let <\/strong>(n\u00e1vrh v \u00a7 39 odst. 2 ZP).<\/li>\n<\/ul>\n<h2>D\u00e9lka zku\u0161ebn\u00ed doby a jej\u00ed prodlou\u017een\u00ed<\/h2>\n<p>MPSV navrhuje nav\u00fd\u0161en\u00ed \u010di prodlou\u017een\u00ed maxim\u00e1ln\u00ed d\u00e9lky zku\u0161ebn\u00ed doby:<\/p>\n<ul>\n<li>a to na z\u00e1klad\u011b vz\u00e1jemn\u00e9 <strong>dohody<\/strong> mezi zam\u011bstnancem a zam\u011bstnavatele (n\u00e1vrh v \u00a7 35 ZP),<\/li>\n<li>u \u0159adov\u00fdch zam\u011bstnanc\u016f by mohla trvat a\u017e \u010dty\u0159i m\u011bs\u00edce (dnes maxim\u00e1ln\u011b 3 m\u011bs\u00edce),<\/li>\n<li>u vedouc\u00edch zam\u011bstnanc\u016f a\u017e osm m\u011bs\u00edc\u016f (dnes maxim\u00e1ln\u011b 6 m\u011bs\u00edc\u016f).<\/li>\n<\/ul>\n<h2>Rozv\u00e1z\u00e1n\u00ed pracovn\u00edho pom\u011bru a neplatn\u00e9 rozv\u00e1z\u00e1n\u00ed<\/h2>\n<p>Novelou z\u00e1kon\u00edku pr\u00e1ce by m\u011blo doj\u00edt ke zm\u011bn\u011b pravidel pro pod\u00e1n\u00ed v\u00fdpov\u011bdi z pracovn\u00edho pom\u011bru:<\/p>\n<ul>\n<li>po\u010d\u00e1tek b\u011bhu v\u00fdpov\u011bdn\u00ed doby by m\u011bl b\u00fdt ji\u017e od datumu doru\u010den\u00ed v\u00fdpov\u011bdi druh\u00e9 stran\u011b (dnes za\u010d\u00edn\u00e1 v\u00fdpov\u011bdn\u00ed doba b\u011b\u017eet a\u017e od prvn\u00edho dne n\u00e1sleduj\u00edc\u00edho m\u011bs\u00edce),<\/li>\n<li>z\u016fstane zachov\u00e1no pravidlo, \u017ee v\u00fdpov\u011bdn\u00ed doba mus\u00ed b\u00fdt stejn\u00e1 pro zam\u011bstnavatele i zam\u011bstnance a \u010din\u00ed nejm\u00e9n\u011b <strong>2 m\u011bs\u00edce<\/strong>, s v\u00fdjimkou vypl\u00fdvaj\u00edc\u00ed z \u00a7 51 ZP,<\/li>\n<li>zam\u011bstnanec by tak mohl b\u00fdt uvoln\u011bn pro novou pracovn\u00ed pozici d\u0159\u00edve a zam\u011bstnavatel by tak\u00e9 mohl na uvoln\u011bn\u00e9 pracovn\u00ed m\u00edsto p\u0159ijmout nov\u00e9ho zam\u011bstnance v krat\u0161\u00edm term\u00ednu,<\/li>\n<li>\u00faplnou novinkou by m\u011blo b\u00fdt zkr\u00e1cen\u00ed v\u00fdpov\u011bdn\u00ed doby na <strong>jeden m\u011bs\u00edc<\/strong> v p\u0159\u00edpad\u011b v\u00fdpov\u011bdi dan\u00e9 z d\u016fvodu, \u017ee zam\u011bstnanec poru\u0161il pracovn\u00ed k\u00e1ze\u0148 nebo nespl\u0148uje z\u00e1konn\u00e9 p\u0159edpoklady \u010di po\u017eadavky zam\u011bstnavatele pro v\u00fdkon pr\u00e1ce dle \u00a7 52 p\u00edsm. f) a\u017e h) (n\u00e1vrh v \u00a7 51 odst. 2 a 3 ZP).<\/li>\n<\/ul>\n<p><strong>Nov\u011b by m\u011bla novela zp\u0159esnit n\u00e1roky zam\u011bstnance p\u0159i neplatn\u00e9m rozv\u00e1z\u00e1n\u00ed pracovn\u00edho pom\u011bru:<\/strong><\/p>\n<ul>\n<li>pokud zam\u011bstnanec usp\u011bje u soudu s \u017ealobou kv\u016fli neplatn\u00e9mu rozv\u00e1z\u00e1n\u00ed pracovn\u00edho pom\u011bru, z\u00edsk\u00e1 ze z\u00e1kona i n\u00e1rok na dovolenou (n\u00e1vrh v \u00a7 69 odst. 1 ZP),<\/li>\n<li>dosud toti\u017e neexistuje pr\u00e1vn\u00ed jistota, zda zam\u011bstnanci skute\u010dn\u011b n\u00e1rok na dovolenou vznik\u00e1.<\/li>\n<\/ul>\n<h2>V\u00fdpov\u011b\u010f ze zdravotn\u00edch d\u016fvod\u016f<\/h2>\n<p>Zam\u011bstnanci, kte\u0159\u00ed z d\u016fvodu nemoci z povol\u00e1n\u00ed nebo pracovn\u00edho \u00farazu nebudou schopni vykon\u00e1vat dosavadn\u00ed pr\u00e1ci, budou m\u00edt v p\u0159\u00edpad\u011b ukon\u010den\u00ed pracovn\u00edho pom\u011bru ze strany zam\u011bstnavatele n\u00e1rok na <strong>jednor\u00e1zovou n\u00e1hradu<\/strong> z povinn\u00e9ho poji\u0161t\u011bn\u00ed zam\u011bstnavatele:<\/p>\n<ul>\n<li>ve v\u00fd\u0161i 12n\u00e1sobku pr\u016fm\u011brn\u00e9ho v\u00fdd\u011blku (n\u00e1vrh v \u00a7 271ca ZP),<\/li>\n<li>jednor\u00e1zovou n\u00e1hradu bude zam\u011bstnavatel povinen zam\u011bstnanci vyplatit po skon\u010den\u00ed pracovn\u00edho pom\u011bru v nejbli\u017e\u0161\u00edm v\u00fdplatn\u00edm term\u00ednu ur\u010den\u00e9m u zam\u011bstnavatele pro v\u00fdplatu mzdy nebo platu, pokud se <strong>p\u00edsemn\u011b <\/strong>nedohodne se zam\u011bstnancem na v\u00fdplat\u011b n\u00e1hrady v den skon\u010den\u00ed pracovn\u00edho pom\u011bru nebo na pozd\u011bj\u0161\u00edm term\u00ednu v\u00fdplaty,<\/li>\n<li>tato zvl\u00e1\u0161tn\u00ed n\u00e1hrada by m\u011bla b\u00fdt nov\u011b zam\u011bstnavateli <strong>refundov\u00e1na poji\u0161\u0165ovnou<\/strong> ze z\u00e1konn\u00e9ho poji\u0161t\u011bn\u00ed zam\u011bstnavatele za \u0161kodu zp\u016fsobenou pracovn\u00edm \u00farazem nebo nemoc\u00ed z\u00a0povol\u00e1n\u00ed,<\/li>\n<li>v sou\u010dasnosti n\u00e1le\u017e\u00ed zam\u011bstnanci v t\u011bchto p\u0159\u00edpadech od zam\u011bstnavatele odstupn\u00e9 ve v\u00fd\u0161i 12n\u00e1sobku pr\u016fm\u011brn\u00e9ho v\u00fdd\u011blku, co\u017e m\u016f\u017ee b\u00fdt zejm\u00e9na pro men\u0161\u00ed zam\u011bstnavatele likvida\u010dn\u00ed, nebo\u0165 z\u00e1konn\u00e9 poji\u0161t\u011bn\u00ed odpov\u011bdnosti za \u0161kodu p\u0159i pracovn\u00edm \u00farazu nebo nemoci z povol\u00e1n\u00ed nepokr\u00fdv\u00e1 n\u00e1rok zam\u011bstnance na odstupn\u00e9,<\/li>\n<li>navr\u017een\u00e1 pr\u00e1vn\u00ed \u00faprava podstatn\u011b sn\u00ed\u017e\u00ed n\u00e1klady zam\u011bstnavatel\u016f pro p\u0159\u00edpady, kdy dojde k rozv\u00e1z\u00e1n\u00ed pracovn\u00edho pom\u011bru se zam\u011bstnancem z d\u016fvodu dlouhodob\u00e9ho pozbyt\u00ed zdravotn\u00ed zp\u016fsobilosti, kter\u00e9 bylo zap\u0159\u00ed\u010din\u011bno pracovn\u00edm \u00farazem \u010di nemoc\u00ed z\u00a0povol\u00e1n\u00ed.<\/li>\n<\/ul>\n<link rel=\"stylesheet\" zam\u011bstnanci nahrazen hned n\u00e1sleduj\u00edc\u00ed den.<\/li>\n<\/ul>\n<h2>Pr\u00e1ce nezletil\u00fdch od 14 let<\/h2>\n<p>Mezi dal\u0161\u00ed novinky pat\u0159\u00ed mo\u017enost, aby nezletil\u00ed ve v\u011bku od 14 let:<\/p>\n<ul>\n<li>vykon\u00e1vali lehk\u00e9 pr\u00e1ce v dob\u011b hlavn\u00edch letn\u00edch pr\u00e1zdnin (n\u00e1vrh v \u00a7 244a ZP),<\/li>\n<li>a to i bez
