Je dobr\u00e9 si pohl\u00eddat, \u017ee v dohod\u011b o rozv\u00e1z\u00e1n\u00ed pracovn\u00edho pom\u011bru zam\u011bstnavatel d\u016fvod uvedl, jinak ztr\u00e1c\u00edte n\u00e1rok na odstupn\u00e9.<\/p>\n<p>Pokud pod\u00e1 v\u00fdpov\u011b\u010f zam\u011bstnanec, nem\u00e1 automaticky n\u00e1rok na odstupn\u00e9.Odstupn\u00e9 se nevypl\u00e1c\u00ed ani kdy\u017e m\u00e1te smlouvu na dobu ur\u010ditou a ta vypr\u0161\u00ed. <strong>Odstupn\u00e9 se d\u00e1le net\u00fdk\u00e1 dohod o proveden\u00ed pr\u00e1ce nebo o proveden\u00ed \u010dinnosti.<\/strong><\/p>\n<p><strong>Zam\u011bstnanci s pracovn\u00edm pom\u011brem na dobu ur\u010ditou<\/strong> nemaj\u00ed po jeho uplynut\u00ed n\u00e1rok na odstupn\u00e9. Speci\u00e1ln\u00ed situace nast\u00e1v\u00e1 v p\u0159\u00edpad\u011b pracovn\u00edho \u00farazu nebo nemoci z povol\u00e1n\u00ed, kdy m\u00e1 zam\u011bstnanec n\u00e1rok na minim\u00e1ln\u011b <strong>dvan\u00e1ctin\u00e1sobek pr\u016fm\u011brn\u00e9ho hrub\u00e9ho v\u00fdd\u011blku<\/strong>. To v\u0161ak neplat\u00ed v p\u0159\u00edpad\u011b, kdy zam\u011bstnavatel prok\u00e1\u017ee, \u017ee zam\u011bstnanec byl opil\u00fd, zdrogovan\u00fd nebo poru\u0161il bezpe\u010dnostn\u00ed p\u0159edpisy, se kter\u00fdmi byl sezn\u00e1men.<\/p>\n<p>Vyplacen\u00ed vy\u0161\u0161\u00edho odstupn\u00e9ho m\u016f\u017ee zam\u011bstnavateli ukl\u00e1dat <strong>kolektivn\u00ed smlouva<\/strong>. Toto od\u0161kodn\u00e9 se vypl\u00e1c\u00ed z poji\u0161t\u011bn\u00ed odpov\u011bdnosti za \u0161kodu p\u0159i pracovn\u00edm \u00farazu \u010di nemoci z povol\u00e1n\u00ed, kter\u00e9 mus\u00ed <strong>zam\u011bstnavatel pro sv\u00e9 zam\u011bstnance z\u0159\u00eddit<\/strong>.<\/p>\n<h2>Kdy se odstupn\u00e9 vypl\u00e1c\u00ed?<\/h2>\n<p>Podle z\u00e1kon\u00edku pr\u00e1ce mus\u00ed zam\u011bstnavatel vyplatit odstupn\u00e9 v <strong>nejbli\u017e\u0161\u00edm v\u00fdplatn\u00edm term\u00ednu<\/strong> od <a href=\"https:\/\/money.cz\/novinky-a-tipy\/mzdy-a-personalistika\/ukonceni-pracovniho-pomeru-neni-jen-tak-co-je-dobre-vedet\/\">skon\u010den\u00ed pracovn\u00edho pom\u011bru.<\/a> Ob\u011b strany se v\u0161ak mohou domluvit na d\u0159\u00edv\u011bj\u0161\u00edm i pozd\u011bj\u0161\u00edm term\u00ednu. Nap\u0159\u00edklad p\u0159\u00edmo ke dni ukon\u010den\u00ed pom\u011bru. Dohoda ale mus\u00ed b\u00fdt p\u00edsemn\u00e1.<\/p>\n<p>Z\u00e1kon mysl\u00ed i na situaci, kdy se zam\u011bstnanec do stejn\u00e9ho zam\u011bstn\u00e1n\u00ed vr\u00e1t\u00ed d\u0159\u00edve ne\u017e po uplynut\u00ed doby, za kterou mu bylo vyplaceno odstupn\u00e9. Tehdy je povinen pom\u011brnou \u010d\u00e1stku zam\u011bstnavateli vr\u00e1tit. Pokud tedy dostane odstupn\u00e9 ve v\u00fd\u0161i t\u0159\u00ed m\u011bs\u00ed\u010dn\u00edch plat\u016f a do zam\u011bstn\u00e1n\u00ed se po dvou m\u011bs\u00edc\u00edch vr\u00e1t\u00ed, mus\u00ed jeden m\u011bs\u00ed\u010dn\u00ed plat zam\u011bstnanci vr\u00e1tit.<\/p>\n<h2>Jak je to s odvody<\/h2>\n<p>Z ka\u017ed\u00e9 v\u00fdplaty zam\u011bstnavatel odv\u00e1d\u00ed povinn\u00e9 z\u00e1lohy na soci\u00e1ln\u00ed a zdravotn\u00ed poji\u0161t\u011bn\u00ed, z odstupn\u00e9ho se v\u0161ak <strong>povinn\u00e9 z\u00e1lohy neplat\u00ed<\/strong>. Odstupn\u00e9 tedy dostanete vy\u0161\u0161\u00ed, ne\u017e je va\u0161e b\u011b\u017en\u00e1 m\u011bs\u00ed\u010dn\u00ed mzda.<\/p>\n<p>Zdan\u011bn\u00ed odstupn\u00e9ho se ale nevyhnete. Plat\u00ed zde <strong>da\u0148 p\u0159\u00edjm\u016f ve v\u00fd\u0161i 15 %<\/strong> stejn\u011b jako u klasick\u00e9ho v\u00fdd\u011blku. Osoby samostatn\u011b v\u00fdd\u011ble\u010dn\u011b \u010dinn\u00e9 (OSV\u010c) <strong>na odstupn\u00e9 n\u00e1rok nemaj\u00ed<\/strong>, proto\u017ee nejsou v postaven\u00ed zam\u011bstnanc\u016f a pracovn\u00ed pom\u011br jim nem\u016f\u017ee b\u00fdt ukon\u010den v\u00fdpov\u011bd\u00ed od zam\u011bstnavatele. <strong>OSV\u010c m\u016f\u017ee z\u00edskat finan\u010dn\u00ed kompenzaci<\/strong> p\u0159i ukon\u010den\u00ed spolupr\u00e1ce pouze tehdy, pokud je sjedn\u00e1na ve smlouv\u011b s obchodn\u00edm partnerem.<\/p>\n<h2>Jak\u00fd je rozd\u00edl mezi odstupn\u00fdm a odchodn\u00fdm<\/h2>\n<p>Mnoho zam\u011bstnavatel\u016f i zam\u011bstnanc\u016f tyto pojmy zam\u011b\u0148uje. <strong>Odstupn\u00e9<\/strong> je pen\u011b\u017eit\u00e1 kompenzace podle z\u00e1kon\u00edku pr\u00e1ce, vypl\u00e1cen\u00e1 p\u0159i skon\u010den\u00ed pracovn\u00edho pom\u011bru z d\u016fvod\u016f na stran\u011b zam\u011bstnavatele (nap\u0159. organiza\u010dn\u00ed zm\u011bny).<\/p>\n<p><strong>Odchodn\u00e9<\/strong> je naopak jednor\u00e1zov\u00e9 pln\u011bn\u00ed poskytovan\u00e9 po skon\u010den\u00ed slu\u017eebn\u00edho pom\u011bru st\u00e1tn\u00edm zam\u011bstnanc\u016fm, jako jsou policist\u00e9, voj\u00e1ci \u010di celn\u00edci, a jeho vyplacen\u00ed se \u0159\u00edd\u00ed z\u00e1konem o st\u00e1tn\u00ed slu\u017eb\u011b (\u010d. 234\/2014 Sb.).<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kdo m\u00e1 n\u00e1rok na odstupn\u00e9 Odstupn\u00e9 se t\u00fdk\u00e1 jen v\u00fdpov\u011bd\u00ed z hlavn\u00edho pracovn\u00edho pom\u011bru ze strany zam\u011bstnavatele.
