Tyto povinnosti se typicky t\u00fdkaj\u00ed <strong>vypracov\u00e1n\u00ed dokument\u016f a jejich p\u0159ed\u00e1n\u00ed p\u0159\u00edslu\u0161n\u00fdm instituc\u00edm<\/strong>.<\/p>\n<p>Person\u00e1ln\u00ed agenda <strong>zahrnuje vypracov\u00e1n\u00ed<\/strong>:<\/p>\n<ul>\n<li><a href=\"https:\/\/money.cz\/novinky-a-tipy\/mzdy-a-personalistika\/zalozeni-a-vznik-pracovniho-pomeru-jak-zbytecne-nechybovat\/\">pracovn\u00edch smluv<\/a>,<\/li>\n<li>dohod o proveden\u00ed pr\u00e1ce nebo \u010dinnosti,<\/li>\n<li>formul\u00e1\u0159\u016f pro zdravotn\u00ed poji\u0161\u0165ovny a spr\u00e1vu soci\u00e1ln\u00edho zabezpe\u010den\u00ed<\/li>\n<li>a dal\u0161\u00edch pracovn\u011bpr\u00e1vn\u00edch dokument\u016f.<\/li>\n<\/ul>\n<p>Sou\u010d\u00e1st\u00ed person\u00e1ln\u00ed agendy by m\u011bla b\u00fdt tak\u00e9 evidence absolvovan\u00fdch \u0161kolen\u00ed BOZP, l\u00e9ka\u0159sk\u00fdch prohl\u00eddek a p\u0159\u00edpadn\u00fdch pracovn\u00edch \u00faraz\u016f.<\/p>\n<p>Pro v\u00fd\u0161e uveden\u00e9 dokumenty zalo\u017e\u00edte ka\u017ed\u00e9mu zam\u011bstnanci<strong> osobn\u00ed spis<\/strong>, a\u0165 u\u017e fyzicky nebo elektronicky. Do n\u011bj ulo\u017e\u00edte v\u0161echny pracovn\u011bpr\u00e1vn\u00ed dokumenty, kter\u00e9 se dan\u00e9ho zam\u011bstnance t\u00fdkaj\u00ed. D\u00edky tomu je v dokumentech p\u0159ehled a snadno je dohled\u00e1te.<\/p>\n<h2>Co je to mzdov\u00e1 agenda<\/h2>\n<p>Mzdov\u00e1 agenda ozna\u010duje <strong>zpracov\u00e1n\u00ed mezd<\/strong>, tedy odm\u011bn za pr\u00e1ci pro zam\u011bstnance. Zpracov\u00e1n\u00ed mezd <strong>zahrnuje v\u00fdpo\u010det<\/strong>:<\/p>\n<ul>\n<li>mzdy,<\/li>\n<li>povinn\u00fdch odvod\u016f zdravotn\u00edho a soci\u00e1ln\u00edho poji\u0161t\u011bn\u00ed,<\/li>\n<li>dan\u011b z p\u0159\u00edjmu,<\/li>\n<li>sr\u00e1\u017eek<\/li>\n<li>a dal\u0161\u00edch d\u00edl\u010d\u00edch slo\u017eek, jako jsou dovolen\u00e9 nebo bonusy.<\/li>\n<\/ul>\n<p>Aby bylo mo\u017en\u00e9 mzdy spr\u00e1vn\u011b vypo\u010d\u00edtat, je pot\u0159eba m\u00edt k dispozici i podklady z:<\/p>\n<ul>\n<li><strong>evidence doch\u00e1zky<\/strong> (p\u0159\u00edchody a odchody),<\/li>\n<li><strong>evidence pracovn\u00ed doby<\/strong> (skute\u010dn\u011b odpracovan\u00e9 hodiny v\u010detn\u011b p\u0159es\u010das\u016f).<\/li>\n<\/ul>\n<p>Po proveden\u00ed v\u00fdpo\u010dt\u016f z\u00edsk\u00e1te podklady pro v\u00fdplatu mezd zam\u011bstnanc\u016fm, p\u0159ehledy pro poji\u0161\u0165ovny a \u00fadaje pro finan\u010dn\u00ed \u00fa\u0159ad. Mzdy m\u016f\u017eete zpracov\u00e1vat ru\u010dn\u011b, v \u00fa\u010detn\u00edm \u010di <a href=\"https:\/\/money.cz\/vlastnosti\/mzdy-a-personalistika-s3\/\">mzdov\u00e9m programu<\/a> nebo si m\u016f\u017eete najmout extern\u00ed \u00fa\u010detn\u00ed agenturu.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-single-post-thumb wp-image-88913\" src=\"https:\/\/money.cz\/novinky-a-tipy\/wp-content\/uploads\/sites\/2\/2022\/01\/jonathan-borba-fNmUtZQwErM-unsplash-1-scaled.jpg\" alt=\"\" width=\"668\" height=\"445\" \/><\/p>\n<h2>Co d\u011blat, kdy\u017e p\u0159ij\u00edm\u00e1te zam\u011bstnance<\/h2>\n<p>Z\u00e1vazky v\u016f\u010di st\u00e1tu a zam\u011bstnanci nab\u00fdvaj\u00ed platnosti od chv\u00edle, kdy se zam\u011bstnancem <strong>podep\u00ed\u0161ete pracovn\u00ed smlouvu \u010di dohodu<\/strong>. Ka\u017ed\u00fd typ pracovn\u011bpr\u00e1vn\u00edho vztahu m\u00e1 sv\u00e1 specifika:<\/p>\n<h3>Pracovn\u00ed smlouva<\/h3>\n<p>Uzav\u00edr\u00e1te ji na dobu ur\u010ditou, nebo neur\u010ditou. Smlouvu na dobu ur\u010ditou m\u016f\u017eete uzav\u0159\u00edt maxim\u00e1ln\u011b na 3 roky s mo\u017enost\u00ed dvou prodlou\u017een\u00ed (celkem tedy a\u017e na 9 let) \u2013 pak u\u017e jedin\u011b na dobu neur\u010ditou.<\/p>\n<p>V\u00fd\u0161i mzdy uvedete bu\u010f p\u0159\u00edmo v pracovn\u00ed smlouv\u011b, nebo v samostatn\u00e9m mzdov\u00e9m v\u00fdm\u011bru. Sou\u010d\u00e1st\u00ed smlouvy mus\u00ed b\u00fdt tak\u00e9 zm\u00ednka o zku\u0161ebn\u00ed dob\u011b (nesm\u00ed p\u0159es\u00e1hnout 4 m\u011bs\u00edce pro \u0159adov\u00e9 zam\u011bstnance, 8 m\u011bs\u00edc\u016f pro vedouc\u00ed pozice).<\/p>\n<h3>Dohoda o proveden\u00ed pr\u00e1ce (DPP)\u00a0<\/h3>\n<p>DPP uzav\u00edr\u00e1te se zam\u011bstnancem, jeho\u017e rozsah pr\u00e1ce nep\u0159ekro\u010d\u00ed 300 hodin za kalend\u00e1\u0159n\u00ed rok. Pokud odm\u011bna nep\u0159es\u00e1hne 11 500 K\u010d za m\u011bs\u00edc, neodv\u00e1d\u00edte z n\u00ed zdravotn\u00ed ani soci\u00e1ln\u00ed poji\u0161t\u011bn\u00ed. Da\u0148 z p\u0159\u00edjmu (15 %) obvykle strh\u00e1v\u00e1te formou sr\u00e1\u017ekov\u00e9 dan\u011b, pokud zam\u011bstnanec <strong>nepodep\u00ed\u0161e Prohl\u00e1\u0161en\u00ed poplatn\u00edka<\/strong>. Pokud prohl\u00e1\u0161en\u00ed podep\u00ed\u0161e, pou\u017eijete da\u0148 z\u00e1lohovou.<\/p>\n<p>Jakmile dohod\u00e1\u0159e p\u0159ijmete, mus\u00edte m\u011bs\u00ed\u010dn\u011b pod\u00e1vat na \u010cSSZ takzvan\u00fd \u201eV\u00fdkaz p\u0159\u00edjm\u016f z\u00fa\u010dtovan\u00fdch zam\u011bstnavatelem zam\u011bstnanc\u016fm \u010dinn\u00fdm na z\u00e1klad\u011b dohody o proveden\u00ed pr\u00e1ce\u201c. Hl\u00e1\u0161en\u00ed mus\u00ed obsahovat informace o n\u00e1stupu, skon\u010den\u00ed zam\u011bstn\u00e1n\u00ed a v\u00fd\u0161i p\u0159\u00edjm\u016f v\u0161ech zam\u011bstnanc\u016f na DPP. A plat\u00ed to i pro zam\u011bstnance s p\u0159\u00edjmem pod 11 500 K\u010d.<\/p>\n<p>Lh\u016fta pro pod\u00e1n\u00ed hl\u00e1\u0161en\u00ed je do 20. dne n\u00e1sleduj\u00edc\u00edho m\u011bs\u00edce a v\u00fdkaz pod\u00e1te elektronicky \u2013 bu\u010f prost\u0159ednictv\u00edm mzdov\u00e9ho softwaru nebo p\u0159es ePort\u00e1l \u010cSSZ.<\/p>\n<h3>Dohoda o pracovn\u00ed \u010dinnosti (DP\u010c)\u00a0<\/h3>\n<p>DP\u010c uzav\u00edr\u00e1te se zam\u011bstnancem, jeho\u017e pr\u00e1ce nep\u0159ekro\u010d\u00ed 20 hodin t\u00fddn\u011b, a to pr\u016fm\u011brn\u011b po celou dobu trv\u00e1n\u00ed DP\u010c \u2013 tak\u017ee jeden t\u00fdden m\u016f\u017ee odpracovat nap\u0159\u00edklad 30 hodin a druh\u00fd 10 hodin. Zdravotn\u00ed a soci\u00e1ln\u00ed poji\u0161t\u011bn\u00ed za tohoto zam\u011bstnance odv\u00e1d\u00edte, pokud odm\u011bna p\u0159es\u00e1hne 4 500 K\u010d m\u011bs\u00ed\u010dn\u011b.<\/p>\n<p>Da\u0148 z p\u0159\u00edjmu (15 %) se vyb\u00edr\u00e1 jako sr\u00e1\u017ekov\u00e1, pokud zam\u011bstnanec nepodepsal Prohl\u00e1\u0161en\u00ed poplatn\u00edka. Pokud odm\u011bna p\u0159es\u00e1hne 4 500 K\u010d nebo m\u00e1 zam\u011bstnanec podepsan\u00e9 prohl\u00e1\u0161en\u00ed, pou\u017eijete z\u00e1lohovou da\u0148.<\/p>\n<h2>Jak\u00e1 jsou povinn\u00e1 hl\u00e1\u0161en\u00ed instituc\u00edm\u00a0<\/h2>\n<p>Jakmile s nov\u00fdm zam\u011bstnancem podep\u00ed\u0161ete smlouvu, m\u00e1te povinnost p\u0159ihl\u00e1sit ho:<\/p>\n<ul>\n<li><strong>do 8 dn\u016f na spr\u00e1vu soci\u00e1ln\u00edho zabezpe\u010den\u00ed<\/strong> <a href=\"https:\/\/i.iinfo.cz\/files\/podnikatel\/urs\/oznameni_o_nastupu_do_prace-124291352688836.pdf\" target=\"_blank\" rel=\"noopener\">p\u0159\u00edslu\u0161n\u00fdm formul\u00e1\u0159em<\/a>,<\/li>\n<li><strong>do 8 dn\u016f k jeho zdravotn\u00ed poji\u0161\u0165ovn\u011b<\/strong> (ka\u017ed\u00e1 m\u00e1 vlastn\u00ed formul\u00e1\u0159).<\/li>\n<\/ul>\n<p>Kdy\u017e to nestihnete, vym\u011b\u0159\u00ed v\u00e1m dan\u00e1 instituce pokutu.<\/p>\n<p>Jestli\u017ee je to v\u00e1\u0161 prvn\u00ed zam\u011bstnanec, mus\u00edte:<\/p>\n<ul>\n<li>do 8 dn\u016f podat p\u0159ihl\u00e1\u0161ku k <a href=\"https:\/\/www.financnisprava.cz\/assets\/tiskopisy\/5101_20.pdf?202008270839\" target=\"_blank\" rel=\"noopener\">registraci k dani ze z\u00e1visl\u00e9 \u010dinnosti<\/a><strong> na finan\u010dn\u00ed \u00fa\u0159ad\u00a0<\/strong><\/li>\n<li>a\u00a0 <strong>zaregistrovat se i k poji\u0161t\u011bn\u00ed odpov\u011bdnosti zam\u011bstnavatele<\/strong> za pracovn\u00ed \u00farazy a nemoci z povol\u00e1n\u00ed \u2013 poji\u0161t\u011bn\u00ed v \u010cesku aktu\u00e1ln\u011b poskytuje pouze <a href=\"https:\/\/www.koop.cz\/pojisteni\/pojisteni-odpovednosti\/zakonne-pojisteni-odpovednosti-zamestnavatele\" target=\"_blank\" rel=\"noopener\">Kooperativa<\/a> a <a href=\"https:\/\/www.generaliceska.cz\/pojisteni-odpovednosti-zamestnavatele\" target=\"_blank\" rel=\"noopener\">Generali \u010cesk\u00e1 poji\u0161\u0165ovna<\/a> (u Generali \u010cP se poji\u0161t\u011bn\u00ed vztahuje jen na zam\u011bstnavatele, kte\u0159\u00ed ho m\u011bli sjedn\u00e1no k 31.\u202f12.\u202f1992 a jejich pr\u00e1vn\u00ed z\u00e1stupce, v\u0161ichni nov\u00ed zam\u011bstnavatel\u00e9 spadaj\u00ed pod Kooperativu).<\/li>\n<\/ul>\n<p>Pokud se zam\u011bstnancem ukon\u010d\u00edte pracovn\u00ed pom\u011br, mus\u00edte ho <strong>do 8 dn\u016f tak\u00e9 odhl\u00e1sit <\/strong>na spr\u00e1v\u011b soci\u00e1ln\u00edho zabezpe\u010den\u00ed a u zdravotn\u00ed poji\u0161\u0165ovny.<\/p>\n<p><strong>Dal\u0161\u00ed povinn\u00e1 hl\u00e1\u0161en\u00ed<\/strong> \u010cSSZ mus\u00ed zam\u011bstnavatel prov\u00e9st, kdy\u017e:<\/p>\n<ul>\n<li>uplyne 14 dn\u016f od n\u00e1stupu zam\u011bstnance do pracovn\u00ed neschopnosti,<\/li>\n<li>zam\u011bstnanec nastupuje na mate\u0159skou dovolenou<\/li>\n<li>nebo p\u0159i vyhotoven\u00ed a p\u0159ed\u00e1v\u00e1n\u00ed eviden\u010dn\u00edch list\u016f d\u016fchodov\u00e9ho poji\u0161t\u011bn\u00ed.<\/li>\n<\/ul>\n<h2>Evidence \u00fadaj\u016f o zam\u011bstnanc\u00edch<\/h2>\n<p>Zam\u011bstnavatel m\u00e1 v\u016f\u010di zam\u011bstnanci povinnosti souvisej\u00edc\u00ed s ochranou osobn\u00edch \u00fadaj\u016f a GDPR. K tomu, aby mohl zam\u011bstnavatel v\u00e9st mzdovou a person\u00e1ln\u00ed agendu, <strong>nepot\u0159ebuje od zam\u011bstnance souhlas<\/strong> \u2013 zpracov\u00e1n\u00ed \u00fadaj\u016f vypl\u00fdv\u00e1 p\u0159\u00edmo ze z\u00e1kona.<\/p>\n<p>Po skon\u010den\u00ed pracovn\u00edho pom\u011bru v\u0161ak mus\u00ed zam\u011bstnavatel vy\u010distit <a href=\"https:\/\/money.cz\/novinky-a-tipy\/mzdy-a-personalistika\/navod-jak-spravne-evidovat-data-o-zamestnancich\/\">osobn\u00ed spisy zam\u011bstnance<\/a> od v\u0161ech \u00fadaj\u016f a dokument\u016f, kter\u00e9 ji\u017e nejsou pot\u0159eba. V osobn\u00ed slo\u017ece by tak <strong>m\u011bly z\u016fstat pouze<\/strong>:<\/p>\n<ul>\n<li>z\u00e1kladn\u00ed dokumenty o pracovn\u00edm pom\u011bru (smlouva, mzdov\u00fd v\u00fdm\u011br apod.),<\/li>\n<li>hodnocen\u00ed zam\u011bstnance pro budouc\u00ed pracovn\u00ed posudky<\/li>\n<li>a doklady slou\u017e\u00edc\u00ed k ochran\u011b pr\u00e1v zam\u011bstnavatele (nap\u0159\u00edklad smlouva o ml\u010denlivosti).<\/li>\n<\/ul>\n<p>Jako zam\u011bstnavatel\u00e9 m\u00e1te povinnost archivovat n\u011bkter\u00e9 dokumenty:<\/p>\n<ul>\n<li><strong>mzdov\u00e9 listy a \u00fa\u010detn\u00ed z\u00e1znamy<\/strong> o \u00fadaj\u00edch pot\u0159ebn\u00fdch pro \u00fa\u010dely d\u016fchodov\u00e9ho poji\u0161t\u011bn\u00ed uchov\u00e1vejte po dobu <strong>45 kalend\u00e1\u0159n\u00edch let <\/strong>n\u00e1sleduj\u00edc\u00edch po roce, ze kter\u00e9ho dokumenty poch\u00e1z\u00ed,<\/li>\n<\/ul>\n<ul>\n<li><strong>doklady o druhu, vzniku a skon\u010den\u00ed pracovn\u00edho vztahu<\/strong>, z\u00e1znamy o <strong>evidenci doch\u00e1zky<\/strong>, origin\u00e1ly <strong>\u017e\u00e1dost\u00ed <\/strong>sv\u00fdch zam\u011bstnanc\u016f nap\u0159\u00edklad o pen\u011b\u017eitou pomoc v mate\u0159stv\u00ed, otcovskou, nebo o\u0161et\u0159ovn\u00e9 <strong>po dobu 10 let<\/strong>.<\/li>\n<\/ul>\n<p>Ka\u017ed\u00fd zam\u011bstnanec m\u00e1 pr\u00e1vo na informace o tom, jak prob\u00edh\u00e1 zpracov\u00e1n\u00ed jeho osobn\u00edch \u00fadaj\u016f. To znamen\u00e1, \u017ee m\u016f\u017ee <strong>kdykoliv po\u017e\u00e1dat o kopii<\/strong> v\u0161ech sv\u00fdch osobn\u00edch \u00fadaj\u016f, kter\u00e9 zam\u011bstnavatel eviduje.<\/p>\n<p>Povinnost chr\u00e1nit osobn\u00ed \u00fadaje se t\u00fdk\u00e1 tak\u00e9 zam\u011bstnavatel\u016f, kte\u0159\u00ed aktu\u00e1ln\u011b <strong>vedou v\u00fdb\u011brov\u00e9 \u0159\u00edzen\u00ed <\/strong>na nov\u00e9ho zam\u011bstnance. Osobn\u00ed \u00fadaje uchaze\u010d\u016f o zam\u011bstn\u00e1n\u00ed mus\u00ed zam\u011bstnavatel\u00e9 po skon\u010den\u00ed v\u00fdb\u011brov\u00e9ho \u0159\u00edzen\u00ed vymazat a <a href=\"https:\/\/www.plotbase.cz\/blog\/navod-jak-napsat-dokonaly-zivotopis\" target=\"_blank\" rel=\"noopener\">vyti\u0161t\u011bn\u00e9 \u017eivotopisy<\/a> nebo motiva\u010dn\u00ed dopisy skartovat.
