Jde o trvalej\u0161\u00ed zam\u011bstnance s pevn\u011b\u00a0 stanoven\u00fdm po\u010dtem odpracovan\u00fdch hodin za t\u00fdden. Pracovn\u00ed pom\u011br se d\u011bl\u00ed na:<\/p>\n<ul>\n<li><strong>pln\u00fd \u00favazek<\/strong> (40 hodin t\u00fddn\u011b)<\/li>\n<li>a <strong>zkr\u00e1cen\u00fd \u00favazek<\/strong> (pod 40 hodin t\u00fddn\u011b).<\/li>\n<\/ul>\n<p>Pracovn\u00ed pom\u011br uzav\u00edr\u00e1te se zam\u011bstnancem na <strong>dobu ur\u010ditou<\/strong>, nebo na <strong>dobu neur\u010ditou<\/strong>. Na dobu ur\u010ditou m\u016f\u017ee smlouva trvat maxim\u00e1ln\u011b 3 roky a m\u016f\u017ee b\u00fdt prodlou\u017eena maxim\u00e1ln\u011b dvakr\u00e1t. Pot\u00e9 mus\u00edte zam\u011bstnanci nab\u00eddnout smlouvu na dobu neur\u010ditou, nebo ukon\u010dit spolupr\u00e1ci.<\/p>\n<p>Pracovn\u00ed pom\u011br vznik\u00e1 podpisem <a href=\"https:\/\/money.cz\/novinky-a-tipy\/mzdy-a-personalistika\/zalozeni-a-vznik-pracovniho-pomeru-jak-zbytecne-nechybovat\/\"><strong>pracovn\u00ed smlouvy<\/strong><\/a>, kter\u00e1 mus\u00ed obsahovat minim\u00e1ln\u011b:<\/p>\n<ul>\n<li>druh vykon\u00e1van\u00e9 pr\u00e1ce,<\/li>\n<li>m\u00edsto v\u00fdkonu pr\u00e1ce<\/li>\n<li>a den n\u00e1stupu do pr\u00e1ce.<\/li>\n<\/ul>\n<h3>Kdy p\u0159ijmout zam\u011bstnance na pracovn\u00ed pom\u011br<\/h3>\n<p>Zam\u011bstnance na pracovn\u00ed pom\u011br p\u0159ijm\u011bte ve chv\u00edli, kdy hled\u00e1te pomocnou ruku na <strong>dlouhodobou a soustavnou pr\u00e1ci<\/strong>. Stabiln\u00ed zam\u011bstnanci se za\u017eit\u00fdmi procesy a know-how budou v\u017edy p\u0159\u00ednosn\u011bj\u0161\u00ed a v\u00fdkonn\u011bj\u0161\u00ed ne\u017e st\u0159\u00eddaj\u00edc\u00ed se brig\u00e1dn\u00edci. Pokud se v\u00e1m zam\u011bstnanec neosv\u011bd\u010d\u00ed, m\u016f\u017eete ho propustit b\u011bhem t\u0159\u00edm\u011bs\u00ed\u010dn\u00ed <strong>zku\u0161ebn\u00ed doby <\/strong>nebo kdykoliv pozd\u011bji s v\u00fdpov\u011bdn\u00ed lh\u016ftou 2 m\u011bs\u00edce.<\/p>\n<p>Oproti jin\u00fdm typ\u016fm smluv ale p\u0159edstavuje zam\u011bstnanec na <a href=\"https:\/\/money.cz\/novinky-a-tipy\/mzdy-a-personalistika\/druhy-pracovnich-pomeru-a-prace-konana-mimo-pracovni-pomer\/\">pracovn\u00ed pom\u011br<\/a> pro zam\u011bstnavatele <strong>v\u011bt\u0161\u00ed n\u00e1klady<\/strong> (nap\u0159\u00edklad za soci\u00e1ln\u00ed a zdravotn\u00edho poji\u0161t\u011bn\u00ed, z n\u011bj\u017e \u010d\u00e1st odv\u00e1d\u00ed zam\u011bstnavatel). Proto se nevyplat\u00ed zam\u011bstnance p\u0159ij\u00edmat, pokud pro n\u011bj nebudete m\u00edt dostatek pr\u00e1ce. Zam\u011bstnanc\u016fm toti\u017e mus\u00edte zaplatit i za pracovn\u00ed dobu, b\u011bhem kter\u00e9 nemaj\u00ed co na pr\u00e1ci, ale jsou fyzicky na pracovi\u0161ti.<\/p>\n<div class=\"info-box\">\n<p>P\u0159e\u010dt\u011bte si, <a href=\"https:\/\/money.cz\/novinky-a-tipy\/mzdy-a-personalistika\/personalni-a-mzdova-agenda-jak-postupovat-pri-nabirani-zamestnancu\/\">co mus\u00edte vy\u0159\u00eddit p\u0159i n\u00e1stupu prvn\u00edho zam\u011bstnance<\/a>.<\/p>\n<\/div>\n<h2>Pr\u00e1ce na dohodu (DPP a DP\u010c)<\/h2>\n<p>Pokud pro zam\u011bstnance na pracovn\u00ed pom\u011br nem\u00e1te dost pr\u00e1ce a sh\u00e1n\u00edte pouze \u010dlov\u011bka na v\u00fdpomoc, vyu\u017eijte<strong> dohodu o proveden\u00ed pr\u00e1ce<\/strong> (DPP) nebo<strong> dohodu o pracovn\u00ed \u010dinnosti<\/strong> (DP\u010c).<\/p>\n<p>Tento typ smlouvy firmy vyu\u017e\u00edvaj\u00ed pro n\u00e1razov\u00e9 pr\u00e1ce mal\u00e9ho rozsahu. U dohod neexistuje minim\u00e1ln\u00ed odpracovan\u00e1 doba, ale naopak maxim\u00e1ln\u00ed.<\/p>\n<ul>\n<li>Na DPP nesm\u00ed zam\u011bstnanec odpracovat <strong>v\u00edce ne\u017e 300 hodin ro\u010dn\u011b<\/strong>.<\/li>\n<li>Na DP\u010c nesm\u00ed zam\u011bstnanec odpracovat <strong>p\u0159es 20 hodin t\u00fddn\u011b<\/strong>.<\/li>\n<\/ul>\n<p>I pro dohody plat\u00ed v\u00fdpov\u011bdn\u00ed lh\u016fta, ale oproti pracovn\u00edmu pom\u011bru je krat\u0161\u00ed a \u010din\u00ed <strong>15 dn\u016f<\/strong>.<\/p>\n<p>Ve v\u011bt\u0161in\u011b p\u0159\u00edpad\u016f za zam\u011bstnance s dohodou <strong>neodv\u00e1d\u00edte zdravotn\u00ed a soci\u00e1ln\u00ed poji\u0161t\u011bn\u00ed<\/strong>. V\u00fdjimkou jsou p\u0159\u00edpady, kdy si <strong>vyd\u011bl\u00e1 v\u00edce ne\u017e<\/strong>:<\/p>\n<ul>\n<li>10 000 K\u010d hrub\u00e9ho m\u011bs\u00ed\u010dn\u011b (DPP)<\/li>\n<li>3 000 K\u010d hrub\u00e9ho m\u011bs\u00ed\u010dn\u011b (DP\u010c).<\/li>\n<\/ul>\n<p>Pamatujte ale, \u017ee stejn\u011b jako u pracovn\u00edho pom\u011bru m\u00e1 zam\u011bstnanec na dohod\u011b n\u00e1rok na z\u00e1konem stanovenou <strong>minim\u00e1ln\u00ed mzdu <\/strong>v p\u0159epo\u010dtu na hodiny. V roce 2020 je minim\u00e1ln\u00ed hodinov\u00e1 mzda <strong>87,30 K\u010d<\/strong>.<\/p>\n<h3>Kdy p\u0159ijmout zam\u011bstnance na dohodu<\/h3>\n<p>Dohod\u00e1\u0159e nab\u00edrejte p\u0159edev\u0161\u00edm jako <strong>v\u00fdpomoc<\/strong>. P\u0159ijm\u011bte je, pokud se v\u00e1m hromad\u00ed n\u00e1razov\u00e1 pr\u00e1ce nebo pot\u0159ebujete trvalou pomoc s drobnou prac\u00ed, kter\u00e1 nevy\u017eaduje osmihodinov\u00e9 sm\u011bny. Stejn\u011b tak jsou zam\u011bstnanci na dohodu dobr\u00e1 volba, pokud se v\u00e1m kr\u00e1tkodob\u011b <strong>nahromad\u00ed pr\u00e1ce<\/strong> (nap\u0159\u00edklad v p\u0159edv\u00e1no\u010dn\u00edm obdob\u00ed).<\/p>\n<p>Pokud jde o n\u00e1razovou pr\u00e1ci rozlo\u017eitelnou do del\u0161\u00edho \u010dasov\u00e9ho obdob\u00ed, zvolte <strong>DP\u010c <\/strong>(nap\u0159\u00edklad administrativn\u00ed pomoc p\u00e1rkr\u00e1t za m\u011bs\u00edc). V p\u0159\u00edpad\u011b intenzivn\u00edch kr\u00e1tkodob\u00fdch prac\u00ed se vyplat\u00ed sp\u00ed\u0161e<strong> DPP<\/strong> (nap\u0159\u00edklad jednor\u00e1zov\u00e1 zak\u00e1zka vy\u017eaduj\u00edc\u00ed 2 t\u00fddny pr\u00e1ce).<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-single-post-thumb wp-image-88960\" src=\"https:\/\/money.cz\/novinky-a-tipy\/wp-content\/uploads\/sites\/2\/2022\/01\/sebastian-herrmann-NbtIDoFKGO8-unsplash-1-scaled.jpg\" alt=\"\" width=\"668\" height=\"445\" \/><\/p>\n<h2>Extern\u00ed spolupr\u00e1ce (I\u010c)<\/h2>\n<p>Pravd\u011bpodobn\u011b jste sly\u0161eli, \u017ee \u0159ada firem \u201ezam\u011bstn\u00e1v\u00e1\u201d lidi takzvan\u011b na I\u010c, tedy na <strong>\u017eivnostensk\u00fd list<\/strong>. Tento zp\u016fsob zam\u011bstn\u00e1v\u00e1n\u00ed lid\u00ed je ale ve skute\u010dnosti neleg\u00e1ln\u00ed a je obecn\u011b zn\u00e1m\u00fd jako <strong>\u0161varcsyst\u00e9m<\/strong>. Zam\u011bstnavatel\u00e9 tento syst\u00e9m zneu\u017e\u00edvaj\u00ed k tomu, aby u\u0161et\u0159ili n\u00e1klady za zam\u011bstnance a nem\u011bli v\u016f\u010di nim tolik z\u00e1vazk\u016f (jako nap\u0159\u00edklad v\u00fdpov\u011bdn\u00ed lh\u016fty, nemocensk\u00e9 nebo propl\u00e1cen\u00ed dovolen\u00fdch).<\/p>\n<p>Na I\u010c m\u016f\u017eete spolupracovat pouze s extern\u00edmi dodavateli. Tedy \u017eivnostn\u00edky, kte\u0159\u00ed maj\u00ed krom\u011b v\u00e1s dal\u0161\u00ed klienty. <strong>Nikdy proto na pohovorech kandid\u00e1t\u016fm nenab\u00edzejte pr\u00e1ci na \u017eivnostensk\u00fd list.<\/strong><\/p>\n<p><strong>O neleg\u00e1ln\u00ed \u0161varcsyst\u00e9m se jedn\u00e1, pokud:<\/strong><\/p>\n<ul>\n<li>je mezi OSV\u010c a zam\u011bstnavatelem vztah nad\u0159\u00edzen\u00fd\/pod\u0159\u00edzen\u00fd,<\/li>\n<li>OSV\u010c vyu\u017e\u00edv\u00e1 zam\u011bstnavatelovy n\u00e1stroje jako nap\u0159\u00edklad kancel\u00e1\u0159 nebo po\u010d\u00edta\u010d,<\/li>\n<li>OSV\u010c nevystupuje s\u00e1m za sebe, ale jm\u00e9nem sv\u00e9ho \u201ezam\u011bstnavatele\u201d,<\/li>\n<li>\u017eivnostn\u00edk fakturuje stejn\u00e9 \u010d\u00e1stky pouze jednomu \u201ezam\u011bstnavateli\u201d,<\/li>\n<li>m\u00e1 OSV\u010c s firmou uzav\u0159enou smlouvu na dlouh\u00e9 \u010dasov\u00e9 obdob\u00ed,<\/li>\n<li>m\u00e1 OSV\u010c pevn\u011b stanovenou pracovn\u00ed dobu,<\/li>\n<li>zam\u011bstnavatel ru\u010d\u00ed za \u0161kodu zp\u016fsobenou OSV\u010c,<\/li>\n<li>m\u00e1 OSV\u010c p\u0159\u00edli\u0161 malou specializaci.<\/li>\n<\/ul>\n<h3>Kdy pracovat s OSV\u010c na extern\u00ed spolupr\u00e1ci<\/h3>\n<p>Podnikatel\u00e9 mohou s OSV\u010c leg\u00e1ln\u011b spolupracovat <strong>outsourcov\u00e1n\u00edm<\/strong>. Pokud nap\u0159\u00edklad firma nebo podnikatel vy\u010dlen\u00ed n\u011bkter\u00e9 \u010dinnosti a sv\u011b\u0159\u00ed je OSV\u010c nebo jin\u00e9 firm\u011b, je to pr\u00e1vn\u011b v po\u0159\u00e1dku. Typicky si t\u00edmto zp\u016fsobem podnikatel\u00e9 naj\u00edmaj\u00ed nap\u0159\u00edklad extern\u00ed \u00fa\u010detn\u00ed, IT spr\u00e1vce, \u00fadr\u017eb\u00e1\u0159e, grafiky a podobn\u011b.<\/p>\n<p>Za extern\u00edho \u017eivnostn\u00edka nikdy <strong>neplat\u00edte soci\u00e1ln\u00ed a zdravotn\u00ed poji\u0161t\u011bn\u00ed a dan\u011b<\/strong>. OSV\u010c si v\u0161echny odvody \u0159e\u0161\u00ed sami, vy jim pouze vyplat\u00edte odm\u011bnu za pr\u00e1ci, kterou si sami nastav\u00ed (nap\u0159\u00edklad podle hodiny \u010di podle hotov\u00fdch \u010dinnost\u00ed). Pracovn\u00ed smlouvu nepodepisujete, ale spolupr\u00e1ci m\u016f\u017eete pr\u00e1vn\u011b o\u0161et\u0159it nap\u0159\u00edklad smlouvou o d\u00edlo.<\/p>\n<p><strong>Ousourcing nen\u00ed \u0161varcsyst\u00e9m<\/strong>, proto\u017ee OSV\u010c:<\/p>\n<ul>\n<li>pracuje samostatn\u011b a nen\u00ed nik\u00fdm \u0159\u00edzen\u00fd,<\/li>\n<li>vykon\u00e1v\u00e1 \u010dinnost pod vlastn\u00edm jm\u00e9nem,<\/li>\n<li>pracuje na vlastn\u00ed odpov\u011bdnost<\/li>\n<li>a m\u00e1 tak\u00e9 dal\u0161\u00ed klienty.<\/li>\n<\/ul>\n<p>Pokud tedy na n\u011bkter\u00e9 d\u00edl\u010d\u00ed \u010dinnosti nechcete nab\u00edrat zam\u011bstnance, ale vysta\u010d\u00edte si s <strong>externistou<\/strong>, vyu\u017eijte tuto mo\u017enost.<\/p>\n<div class=\"info-box\">\n<p>Pokud naj\u00edm\u00e1te prvn\u00ed zam\u011bstnance a hled\u00e1te n\u00e1stroj pro veden\u00ed person\u00e1ln\u00ed agendy a mezd, vyzkou\u0161ejte si zdarma modul <a href=\"https:\/\/money.cz\/vlastnosti\/mzdy-a-personalistika-s3\/\">Mzdy a personalistika<\/a> v ekonomick\u00e9mu syst\u00e9mu pro mal\u00e9 a st\u0159edn\u00ed firmy <a href=\"https:\/\/money.cz\/cenik-s3\/vyzkouset-money-s3\/\">Money S3<\/a>.<\/p>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>Pracovn\u00ed pom\u011br (HPP a zkr\u00e1cen\u00fd \u00favazek) Zam\u011bstnanci s pracovn\u00edm pom\u011brem tvo\u0159\u00ed j\u00e1dro firmy.
