Do firmy jste p\u0159ijali zam\u011bstnance, u kter\u00e9ho jste se domn\u00edvali, \u017ee se nejl\u00e9pe hod\u00ed pro v\u00fdkon dan\u00e9 pr\u00e1ce, ale jak se \u0159\u00edk\u00e1: \u201eDo lid\u00ed a do meloun\u016f nevid\u00ed\u0161\u201c, tak\u017ee se \u010dasem projev\u00ed, \u017ee volba dan\u00e9ho \u010dlov\u011bka nebyla v\u016fbec \u0161\u0165astn\u00e1, a pro firmu bude nejlep\u0161\u00ed se s\u00a0takov\u00fdmto \u010dlov\u011bkem rozlou\u010dit. Jak tedy na to?<\/p>\n<h2>Ukon\u010den\u00ed pracovn\u00edho pom\u011bru ve zku\u0161ebn\u00ed dob\u011b<\/h2>\n<p>Zku\u0161ebn\u00ed doba je obdob\u00ed, v\u00a0r\u00e1mci n\u011bho\u017e doch\u00e1z\u00ed k\u00a0vz\u00e1jemn\u00e9mu \u201eo\u0165uk\u00e1v\u00e1n\u00ed\u201c zam\u011bstnance a\u00a0zam\u011bstnavatele. V\u00a0tomto obdob\u00ed se v\u0161ak m\u016f\u017ee st\u00e1t, \u017ee zjist\u00edte, \u017ee V\u00e1mi vybran\u00fd zam\u011bstnanec se na danou pr\u00e1ci a\u017e tak nehod\u00ed, pop\u0159. \u017ee naprosto nezapadne do Va\u0161\u00ed firmy. Nen\u00ed tedy nic neobvykl\u00e9ho, \u017ee se firma se zam\u011bstnancem v\u00a0tomto obdob\u00ed rozlou\u010d\u00ed.<\/p>\n<h3>Co je zku\u0161ebn\u00ed doba<\/h3>\n<p><strong>Zku\u0161ebn\u00ed doba<\/strong> je <strong>specifikov\u00e1na v <\/strong><a href=\"https:\/\/businesscenter.podnikatel.cz\/pravo\/zakony\/zakonik-prace\/f3053382\/#p35\" target=\"_blank\" rel=\"noopener\">\u00a7 35 z\u00e1kona \u010d. 262\/2006 Sb. z\u00e1kon\u00edku pr\u00e1ce<\/a><strong>.<\/strong> B\u011b\u017en\u011b je uv\u00e1d\u011bna v\u00a0r\u00e1mci pracovn\u00ed smlouvy, proto\u017ee mus\u00ed b\u00fdt sjedn\u00e1na: za prv\u00e9 <strong>p\u00edsemn\u011b\u00a0<\/strong>a za druh\u00e9 <strong>nejpozd\u011bji v\u00a0den n\u00e1stupu do pr\u00e1ce<\/strong>. Zku\u0161ebn\u00ed doba nesm\u00ed b\u00fdt sjedn\u00e1na del\u0161\u00ed, ne\u017e je polovina sjednan\u00e9 doby trv\u00e1n\u00ed pracovn\u00edho pom\u011bru (v p\u0159\u00edpad\u011b smlouvy na dobu ur\u010ditou) a z\u00e1rove\u0148 nesm\u00ed b\u00fdt del\u0161\u00ed ne\u017e 3 m\u011bs\u00edce po sob\u011b jdouc\u00ed ode dne vzniku pracovn\u00edho pom\u011bru, resp. 6 m\u011bs\u00edc\u016f po sob\u011b jdouc\u00edch ode dne vzniku pracovn\u00edho pom\u011bru u vedouc\u00edho zam\u011bstnance. Zku\u0161ebn\u00ed dobu nem\u016f\u017eete nijak opakovat ani prodlu\u017eovat (vyjma celodenn\u00edch p\u0159ek\u00e1\u017eek v\u00a0pr\u00e1ci a celodenn\u00ed \u010derpan\u00e9 dovolen\u00e9).<\/p>\n<p>TIP: Na \u010derp\u00e1n\u00ed dovolen\u00e9 b\u011bhem zku\u0161ebn\u00ed doby se m\u016f\u017eete zeptat odborn\u00edka na pracovn\u00ed pr\u00e1vo pod \u010dl\u00e1nkem <a href=\"https:\/\/www.pracomat.cz\/poradna\/zakonik-prace\/142-zakonik-prace-cast-9-hlava-4-dil-2.html\">o n\u00e1roku na dovolenou a \u010derp\u00e1n\u00ed dovolen\u00e9 podle z\u00e1kon\u00edku pr\u00e1ce na Pracomat.cz<\/a>.<\/p>\n<h3>Jak na ukon\u010den\u00ed pracovn\u00edho pom\u011bru ve zku\u0161ebn\u00ed dob\u011b?<\/h3>\n<p>Ve zku\u0161ebn\u00ed dob\u011b m\u016f\u017eete zam\u011bstnanci \u201evypov\u011bd\u011bt\u201c smlouvu <strong>bez ud\u00e1n\u00ed d\u016fvodu<\/strong>. Nen\u00ed zde \u017e\u00e1dn\u00e1 v\u00fdpov\u011bdn\u00ed lh\u016fta, kterou byste museli dodr\u017eet, a nevznik\u00e1 V\u00e1m ani povinnost vyplatit zam\u011bstnanci odstupn\u00e9. \u201eV\u00fdpov\u011b\u010f\u201c mus\u00ed b\u00fdt zam\u011bstnanci doru\u010dena do konce zku\u0161ebn\u00ed doby. Pracovn\u00ed pom\u011br kon\u010d\u00ed dnem jej\u00edho doru\u010den\u00ed. Pokud byste v\u0161ak ve \u201ev\u00fdpov\u011bdi\u201c uvedli konkr\u00e9tn\u00ed datum ukon\u010den\u00ed pracovn\u00edho pom\u011bru a dokument by byl druh\u00e9 stran\u011b doru\u010den je\u0161t\u011b p\u0159ed zm\u00edn\u011bn\u00fdm datem, pracovn\u00ed pom\u011br skon\u010d\u00ed k tomuto datu. Jestli\u017ee by v\u0161ak byla \u201ev\u00fdpov\u011b\u010f\u201c doru\u010dena a\u017e po tomto datu, pracovn\u00ed pom\u011br kon\u010d\u00ed doru\u010den\u00edm.<\/p>\n<p>A pozor! \u201eV\u00fdpov\u011b\u010f\u201c mus\u00ed m\u00edt v\u017edy <strong>p\u00edsemnou formu<\/strong>, jinak je neplatn\u00e1.<\/p>\n<p>Pro\u010d uv\u00e1d\u00edme slovo v\u00fdpov\u011b\u010f v\u00a0uvozovk\u00e1ch? Dokument byste rozhodn\u011b nem\u011bli naz\u00fdvat \u201eV\u00fdpov\u011b\u010f ve zku\u0161ebn\u00ed dob\u011b\u201c, ale spr\u00e1vn\u011b \u201eUkon\u010den\u00ed pracovn\u00edho pom\u011bru ve zku\u0161ebn\u00ed dob\u011b\u201c. Pojem \u201ev\u00fdpov\u011b\u010f ve zku\u0161ebn\u00ed dob\u011b\u201c toti\u017e z\u00e1kon\u00edk pr\u00e1ce nezn\u00e1.<\/p>\n<p>Pro veden\u00ed pracovn\u00edch pom\u011br\u016f je vhodn\u00fd <a href=\"https:\/\/money.cz\/vlastnosti\/mzdy-a-personalistika-s3\/\">modul Mzdy a personalistika v \u00fa\u010detn\u00edm syst\u00e9mu Money S3<\/a>.<\/p>\n<h3>Nemocensk\u00e1 ve zku\u0161ebn\u00ed dob\u011b<\/h3>\n<p><strong>Pokud zam\u011bstnanec ve zku\u0161ebn\u00ed dob\u011b onemocn\u00ed, je chr\u00e1n\u011bn p\u0159ed \u201ev\u00fdpov\u011bd\u00ed\u201c pouze prvn\u00edch 14 dn\u00ed nemoci<\/strong><strong>.<\/strong> Pokud byste toti\u017e zam\u011bstnanci v\u00a0t\u00e9to lh\u016ft\u011b dali \u201ev\u00fdpov\u011b\u010f\u201c, bude neplatn\u00e1. \u201eV\u00fdpov\u011b\u010f\u201c tedy m\u016f\u017eete d\u00e1t a\u017e 15. den, kdy je zam\u011bstnanec na nemocensk\u00e9. Pokud je zam\u011bstnanec nemocen krat\u0161\u00ed dobu ne\u017e 2 t\u00fddny, zku\u0161ebn\u00ed doba se o dny str\u00e1ven\u00e9 na nemocensk\u00e9 prodlu\u017euje, tak\u017ee i Vy m\u00e1te prodlou\u017een\u00fd prostor na ukon\u010den\u00ed pracovn\u00edho pom\u011bru ve zku\u0161ebn\u00ed dob\u011b.<\/p>\n<p><strong>D\u00e1vejte si v\u0161ak pozor na mo\u017enost, kdy l\u00e9ka\u0159 m\u016f\u017ee zam\u011bstnance uznat pr\u00e1ce neschopn\u00fdm a\u017e 3 dny zp\u011bt!<\/strong><\/p>\n<h2>Rozv\u00e1z\u00e1n\u00ed pracovn\u00edho pom\u011bru dohodou<\/h2>\n<p>Zam\u011bstnavatel se m\u016f\u017ee se sv\u00fdm zam\u011bstnancem dohodnout na rozv\u00e1z\u00e1n\u00ed pracovn\u00edho pom\u011bru tzv. dohodou. Tuto mo\u017enost upravuje <a href=\"https:\/\/businesscenter.podnikatel.cz\/pravo\/zakony\/zakonik-prace\/f3053506\/#cast2-hlava4-dil2\" target=\"_blank\" rel=\"noopener\">\u00a7 49 z\u00e1kona \u010d. 262\/2006 Sb. z\u00e1kon\u00edku pr\u00e1ce<\/a>. Pracovn\u00ed pom\u011br v\u00a0tomto p\u0159\u00edpad\u011b kon\u010d\u00ed sjednan\u00fdm dnem. Dohoda o rozv\u00e1z\u00e1n\u00ed pracovn\u00edho pom\u011bru mus\u00ed m\u00edt op\u011bt p\u00edsemnou podobu.<\/p>\n<h3>N\u00e1rok na odstupn\u00e9 p\u0159i rozv\u00e1z\u00e1n\u00ed pracovn\u00edho pom\u011bru dohodou<\/h3>\n<p><a href=\"https:\/\/money.cz\/novinky-a-tipy\/mzdy-a-personalistika\/ma-zamestnanec-narok-odstupne\/\" target=\"_blank\" rel=\"noopener\">Odstupn\u00e9<\/a> n\u00e1le\u017e\u00ed zam\u011bstnanci p\u0159i skon\u010den\u00ed pracovn\u00edho pom\u011bru dohodou pouze v\u00a0p\u0159\u00edpad\u011b, \u017ee je to v\u00a0dohod\u011b jednozna\u010dn\u011b uvedeno, pop\u0159. je v\u00a0dohod\u011b uveden d\u016fvod ukon\u010den\u00ed pracovn\u00edho pom\u011bru z organiza\u010dn\u00edch nebo zdravotn\u00edch d\u016fvod\u016f. U zdravotn\u00edch d\u016fvod\u016f jde konkr\u00e9tn\u011b o p\u0159\u00edpad, kdy zam\u011bstnanec nesm\u00ed (podle l\u00e9ka\u0159sk\u00e9ho posudku vydan\u00e9ho za\u0159\u00edzen\u00edm z\u00e1vodn\u00ed preventivn\u00ed p\u00e9\u010de nebo rozhodnut\u00edm \u00fa\u0159adu, kter\u00fd posudek p\u0159ezkoum\u00e1v\u00e1) d\u00e1le konat dosavadn\u00ed pr\u00e1ci pro pracovn\u00ed \u00faraz, onemocn\u011bn\u00ed nemoc\u00ed z povol\u00e1n\u00ed nebo pro ohro\u017een\u00ed touto nemoc\u00ed, anebo dos\u00e1hl-li na pracovi\u0161ti ur\u010den\u00e9m rozhodnut\u00edm p\u0159\u00edslu\u0161n\u00e9ho org\u00e1nu ochrany ve\u0159ejn\u00e9ho zdrav\u00ed nejvy\u0161\u0161\u00ed p\u0159\u00edpustn\u00e9 expozice. V\u00a0ostatn\u00edch p\u0159\u00edpadech je zam\u011bstnanec bez n\u00e1roku na odstupn\u00e9.<\/p>\n<p>Minim\u00e1ln\u00ed v\u00fd\u0161e odstupn\u00e9ho je obecn\u011b o\u0161et\u0159ena <a href=\"https:\/\/businesscenter.podnikatel.cz\/pravo\/zakony\/zakonik-prace\/f3053506\/#cast2-hlava4-dil8\" target=\"_blank\" rel=\"noopener\">\u00a7 67 z\u00e1kona \u010d. 262\/2006 Sb. z\u00e1kon\u00edku pr\u00e1ce<\/a><strong>, m\u016f\u017ee v\u0161ak b\u00fdt \u0159e\u0161ena i vnit\u0159n\u00ed sm\u011brnic\u00ed nebo individu\u00e1ln\u00ed dohodou.<\/strong><\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-large wp-image-5762\" src=\"https:\/\/money.cz\/novinky-a-tipy\/wp-content\/uploads\/2021\/08\/pexels-pixabay-48148-1024x681.jpg\" alt=\"\" width=\"1024\" height=\"681\" \/><\/p>\n<h2>V\u00fdpov\u011b\u010f ze strany zam\u011bstnavatele<\/h2>\n<p>St\u00e1vaj\u00edc\u00ed pracovn\u011bpr\u00e1vn\u00ed legislativa bohu\u017eel pohl\u00ed\u017e\u00ed na zam\u011bstnance jako na \u201eslab\u0161\u00ed\u201c \u010dl\u00e1nek, kter\u00fd pot\u0159ebuje zvl\u00e1\u0161tn\u00ed z\u00e1konnou ochranu. Proto jako zam\u011bstnavatel nem\u016f\u017eete pracovn\u00edka vyhodit jen na z\u00e1klad\u011b sv\u00e9 libov\u016fle, ale mus\u00edte k\u00a0tomu m\u00edt i z\u00e1konn\u00fd d\u016fvod, kter\u00fd je uveden v <a href=\"https:\/\/businesscenter.podnikatel.cz\/pravo\/zakony\/zakonik-prace\/f3053506\/#cast2-hlava4-dil3\" target=\"_blank\" rel=\"noopener\">\u00a7 52 z\u00e1kona \u010d. 262\/2006 Sb. z\u00e1kon\u00edku pr\u00e1ce<\/a>.<strong> Ve zkratce se jedn\u00e1 o tyto d\u016fvody:<\/strong><\/p>\n<ul>\n<li>ru\u0161\u00ed-li se nebo p\u0159em\u00eds\u0165uje-li se firma nebo jej\u00ed \u010d\u00e1st,<\/li>\n<li>stane-li se zam\u011bstnanec nadbyte\u010dn\u00fdm,<\/li>\n<li>nen\u00ed-li zam\u011bstnanec zdravotn\u011b zp\u016fsobil\u00fd vykon\u00e1vat danou pr\u00e1ci,<\/li>\n<li>nespl\u0148uje-li zam\u011bstnanec p\u0159edpoklady stanoven\u00e9 pr\u00e1vn\u00edmi p\u0159edpisy pro v\u00fdkon sjednan\u00e9 pr\u00e1ce nebo nespl\u0148uje-li bez zavin\u011bn\u00ed zam\u011bstnavatele po\u017eadavky<br \/>pro \u0159\u00e1dn\u00fd v\u00fdkon t\u00e9to pr\u00e1ce;<\/li>\n<li>jsou-li u zam\u011bstnance d\u00e1ny d\u016fvody, pro kter\u00e9 by s n\u00edm zam\u011bstnavatel mohl okam\u017eit\u011b zru\u0161it pracovn\u00ed pom\u011br, nebo pro z\u00e1va\u017en\u00e9 poru\u0161en\u00ed povinnost\u00ed.<\/li>\n<\/ul>\n<p>V\u00fdpov\u011b\u010f mus\u00ed b\u00fdt p\u00edsemn\u00e1 a mus\u00ed b\u00fdt doru\u010dena druh\u00e9mu \u00fa\u010dastn\u00edkovi, jinak je neplatn\u00e1. Pracovn\u00ed pom\u011br pak\u00a0kon\u010d\u00ed uplynut\u00edm v\u00fdpov\u011bdn\u00ed doby (min. 2 m\u011bs\u00edce), kter\u00e1 za\u010d\u00edn\u00e1 prvn\u00edm dnem n\u00e1sleduj\u00edc\u00edho kalend\u00e1\u0159n\u00edho m\u011bs\u00edce.<\/p>\n<p>Minim\u00e1ln\u00ed v\u00fd\u0161e odstupn\u00e9ho v\u00a0tomto p\u0159\u00edpad\u011b je uvedena <a href=\"https:\/\/businesscenter.podnikatel.cz\/pravo\/zakony\/zakonik-prace\/f3053506\/#cast2-hlava4-dil8\" target=\"_blank\" rel=\"noopener\">\u00a7 67 z\u00e1kona \u010d. 262\/2006 Sb. z\u00e1kon\u00edku pr\u00e1ce<\/a><strong>, v\u00fd\u0161e odstupn\u00e9ho v\u0161ak m\u016f\u017ee b\u00fdt \u0159e\u0161ena i vnit\u0159n\u00ed sm\u011brnic\u00ed.<\/strong><\/p>\n<h3>Z\u00e1kaz v\u00fdpov\u011bdi<\/h3>\n<p>V\u00a0\u017eivot\u011b se vyskytuj\u00ed i situace, kdy zam\u011bstnavatel nesm\u00ed d\u00e1t zam\u011bstnanci\u00a0v\u00fdpov\u011b\u010f, proto\u017ee se nach\u00e1z\u00ed\u00a0v\u00a0tzv. ochrann\u00e9 dob\u011b (viz <a href=\"https:\/\/businesscenter.podnikatel.cz\/pravo\/zakony\/zakonik-prace\/f3053506\/#cast2-hlava4-dil3\" target=\"_blank\" rel=\"noopener\">\u00a7 53 z\u00e1kona \u010d. 262\/2006 Sb. z\u00e1kon\u00edku pr\u00e1ce<\/a>). Jedn\u00e1 se nap\u0159\u00edklad o zam\u011bstnance v\u00a0pracovn\u00ed neschopnosti, b\u011bhem t\u011bhotenstv\u00ed, mate\u0159sk\u00e9 a rodi\u010dovsk\u00e9 dovolen\u00e9 nebo b\u011bhem jeho uvoln\u011bn\u00ed pro v\u00fdkon ve\u0159ejn\u00e9 funkce. Zam\u011bstnanc\u016fm v\u00a0ochrann\u00e9 dob\u011b m\u016f\u017ee zam\u011bstnavatel d\u00e1t v\u00fdpov\u011b\u010f pouze ve v\u00fdjime\u010dn\u00fdch p\u0159\u00edpadech, jako je t\u0159eba zru\u0161en\u00ed nebo p\u0159em\u00edst\u011bn\u00ed zam\u011bstnavatele.<\/p>\n<h2>Okam\u017eit\u00e9 zru\u0161en\u00ed pracovn\u00edho pom\u011bru<\/h2>\n<p>Okam\u017eit\u00e9 zru\u0161en\u00ed pracovn\u00edho pom\u011bru\u00a0m\u016f\u017ee nastat v\u017edy jen v p\u0159\u00edpadech stanoven\u00fdch z\u00e1konem (a to a\u0165 u\u017e ze strany zam\u011bstnavatele \u010di zam\u011bstnance).<\/p>\n<p>Zam\u011bstnavatel m\u016f\u017ee okam\u017eit\u011b rozv\u00e1zat pracovn\u00ed pom\u011br v\u00a0p\u0159\u00edpad\u011b:<\/p>\n<ul>\n<li>byl-li zam\u011bstnanec pravomocn\u011b odsouzen pro \u00famysln\u00fd trestn\u00fd \u010din k nepodm\u00edn\u011bn\u00e9mu trestu odn\u011bt\u00ed svobody na dobu del\u0161\u00ed ne\u017e 1 rok, nebo byl-li pravomocn\u011b odsouzen pro \u00famysln\u00fd trestn\u00fd \u010din sp\u00e1chan\u00fd p\u0159i pln\u011bn\u00ed pracovn\u00edch \u00fakol\u016f nebo v p\u0159\u00edm\u00e9 souvislosti s n\u00edm k nepodm\u00edn\u011bn\u00e9mu trestu odn\u011bt\u00ed svobody na dobu nejm\u00e9n\u011b 6 m\u011bs\u00edc\u016f (viz <a href=\"https:\/\/businesscenter.podnikatel.cz\/pravo\/zakony\/zakonik-prace\/f3053506\/#cast2-hlava4-dil4\" target=\"_blank\" rel=\"noopener\">\u00a7 55 odst. 1 p\u00edsm. a) z\u00e1kona \u010d. 262\/2006 Sb. z\u00e1kon\u00edku pr\u00e1ce<\/a>),<\/li>\n<li>poru\u0161il-li zam\u011bstnanec povinnost vypl\u00fdvaj\u00edc\u00ed z pr\u00e1vn\u00edch p\u0159edpis\u016f vztahuj\u00edc\u00edch se k j\u00edm vykon\u00e1van\u00e9 pr\u00e1ci zvl\u00e1\u0161\u0165 hrub\u00fdm zp\u016fsobem (viz <a href=\"https:\/\/businesscenter.podnikatel.cz\/pravo\/zakony\/zakonik-prace\/f3053506\/#cast2-hlava4-dil4\" target=\"_blank\" rel=\"noopener\">\u00a7 55 odst. 1 p\u00edsm. b) z\u00e1kona \u010d. 262\/2006 Sb. z\u00e1kon\u00edku pr\u00e1ce<\/a>).<\/li>\n<\/ul>\n<p>V t\u011bchto uveden\u00fdch p\u0159\u00edpadech zam\u011bstnavatel zam\u011bstnanci odstupn\u00e9 nevypl\u00e1c\u00ed. Sou\u010dasn\u011b plat\u00ed ustanoven\u00ed, \u017ee zam\u011bstnavatel nesm\u00ed okam\u017eit\u011b zru\u0161it pracovn\u00ed pom\u011br s t\u011bhotnou zam\u011bstnankyn\u00ed, zam\u011bstnankyn\u00ed na mate\u0159sk\u00e9 dovolen\u00e9 ani zam\u011bstnancem nebo zam\u011bstnankyn\u00ed, kte\u0159\u00ed \u010derpaj\u00ed rodi\u010dovskou dovolenou.<\/p>\n<p>P\u0159i okam\u017eit\u00e9m zru\u0161en\u00ed pracovn\u00edho pom\u011bru mus\u00edte skutkov\u011b vymezit jeho d\u016fvod tak, aby jej nebylo mo\u017eno zam\u011bnit s jin\u00fdm. Uveden\u00fd d\u016fvod nesm\u00ed b\u00fdt dodate\u010dn\u011b m\u011bn\u011bn.
