Nej\u010dast\u011bji je zalo\u017een\u00fd pracovn\u00ed smlouvou. Obecn\u011b lze \u0159\u00edci, \u017ee pracovn\u00ed smlouva tak deklaruje vz\u00e1jemnou dohodu mezi zam\u011bstnancem a zam\u011bstnavatelem. A pr\u00e1v\u011b z\u00a0tohoto d\u016fvodu lze z\u00e1sadn\u011b jej\u00ed <strong>zm\u011bny, resp. zm\u011bny ve\u0161ker\u00fdch smluvn\u00edch ustanoven\u00ed, u\u010dinit pouze se souhlasem obou smluvn\u00edch stran<\/strong>, nevypl\u00fdv\u00e1-li ze ZP n\u011bco jin\u00e9ho. M\u016f\u017ee se jednat jak o zm\u011bny tzv. nezbytn\u00fdch n\u00e1le\u017eitost\u00ed pracovn\u00ed smlouvy (tj. dne n\u00e1stupu do pr\u00e1ce, druhu pr\u00e1ce a m\u00edsta v\u00fdkonu pr\u00e1ce), tak i o zm\u011bny ujedn\u00e1n\u00ed typu doby trv\u00e1n\u00ed pracovn\u00edho pom\u011bru a dal\u0161\u00edch.<\/p>\n<p>Jeliko\u017e ZP ukl\u00e1d\u00e1 sjedn\u00e1n\u00ed pracovn\u00edho pom\u011bru povinn\u011b p\u00edsemnou formou, mus\u00ed b\u00fdt p\u00edsemn\u00e1 forma zachov\u00e1na i v p\u0159\u00edpad\u011b <strong>ve\u0161ker\u00fdch zm\u011bn pracovn\u00edho pom\u011bru<\/strong>.<\/p>\n<h2>Zm\u011bna pracovn\u00edho pom\u011bru na z\u00e1klad\u011b jednostrann\u00e9ho opat\u0159en\u00ed zam\u011bstnavatele<\/h2>\n<p>Ke zm\u011bn\u011b pracovn\u00edch podm\u00ednek sjednan\u00fdch v\u00a0pracovn\u00ed smlouv\u011b bez souhlasu zam\u011bstnance m\u016f\u017ee doj\u00edt jen ve zcela v\u00fdjime\u010dn\u00fdch p\u0159\u00edpadech. Tyto p\u0159\u00edpady jsou v\u00a0ZP taxativn\u011b uvedeny (tzn. nelze je d\u00e1le libovoln\u011b roz\u0161i\u0159ovat) v\u00a0<a href=\"https:\/\/www.zakonyprolidi.cz\/cs\/2006-262?text=%C2%A7%2041\" target=\"_blank\" rel=\"noopener\">\u00a7 41<\/a>, pokud jde o\u00a0jednostrannou zm\u011bnu sjednan\u00e9ho druhu pr\u00e1ce (p\u0159eveden\u00ed na jinou pr\u00e1ci).<\/p>\n<p>P\u0159i zm\u011bn\u011b pracovn\u00edho pom\u011bru mus\u00ed zam\u011bstnavatel zam\u011bstnanci do jednoho m\u011bs\u00edce od \u00fa\u010dinnosti takov\u00e9 zm\u011bny znovu p\u0159edat p\u00edsemn\u011b informace uveden\u00e9 v\u00a0<a href=\"https:\/\/www.zakonyprolidi.cz\/cs\/2006-262?text=%C2%A7%2037\" target=\"_blank\" rel=\"noopener\">\u00a7 37 odst. 1<\/a>, respektive minim\u00e1ln\u011b ty informace, kter\u00e9 byly zm\u011bnou dot\u010deny.<\/p>\n<h3>Zm\u011bna pracovn\u00ed pozice a p\u0159eveden\u00ed na jinou pr\u00e1ci<\/h3>\n<p>Dle <a href=\"https:\/\/www.zakonyprolidi.cz\/cs\/2006-262?text=%C2%A7%2041\" target=\"_blank\" rel=\"noopener\">\u00a7 41<\/a> je zam\u011bstnavatel <strong>povinen<\/strong> p\u0159ev\u00e9st zam\u011bstnance na jinou pr\u00e1ci,<\/p>\n<ol>\n<li><strong>pozbyl-li zam\u011bstnanec<\/strong> <strong>vzhledem ke sv\u00e9mu zdravotn\u00edmu stavu<\/strong> podle l\u00e9ka\u0159sk\u00e9ho posudku vydan\u00e9ho poskytovatelem pracovn\u011bl\u00e9ka\u0159sk\u00fdch slu\u017eeb nebo rozhodnut\u00ed p\u0159\u00edslu\u0161n\u00e9ho spr\u00e1vn\u00edho org\u00e1nu, kter\u00fd l\u00e9ka\u0159sk\u00fd posudek p\u0159ezkoum\u00e1v\u00e1, <strong>dlouhodob\u011b zp\u016fsobilosti konat d\u00e1le dosavadn\u00ed pr\u00e1ci<\/strong>,<\/li>\n<li><strong>nesm\u00ed-li<\/strong> podle l\u00e9ka\u0159sk\u00e9ho posudku vydan\u00e9ho poskytovatelem pracovn\u011bl\u00e9ka\u0159sk\u00fdch slu\u017eeb nebo rozhodnut\u00ed p\u0159\u00edslu\u0161n\u00e9ho spr\u00e1vn\u00edho org\u00e1nu, kter\u00fd l\u00e9ka\u0159sk\u00fd posudek p\u0159ezkoum\u00e1v\u00e1, d\u00e1le <strong>konat dosavadn\u00ed pr\u00e1ci pro pracovn\u00ed \u00faraz, onemocn\u011bn\u00ed nemoc\u00ed z povol\u00e1n\u00ed nebo pro ohro\u017een\u00ed touto nemoc\u00ed, anebo dos\u00e1hl-li na pracovi\u0161ti ur\u010den\u00e9m rozhodnut\u00edm p\u0159\u00edslu\u0161n\u00e9ho org\u00e1nu ochrany ve\u0159ejn\u00e9ho zdrav\u00ed nejvy\u0161\u0161\u00ed p\u0159\u00edpustn\u00e9 expozice<\/strong>,<\/li>\n<li><strong>kon\u00e1-li t\u011bhotn\u00e1 zam\u011bstnankyn\u011b, zam\u011bstnankyn\u011b, kter\u00e1 koj\u00ed, nebo zam\u011bstnankyn\u011b-matka do konce dev\u00e1t\u00e9ho m\u011bs\u00edce po porodu pr\u00e1ci, kterou nesm\u011bj\u00ed b\u00fdt tyto zam\u011bstnankyn\u011b zam\u011bstn\u00e1v\u00e1ny nebo kter\u00e1 <\/strong>podle l\u00e9ka\u0159sk\u00e9ho posudku<strong> ohro\u017euje jej\u00ed t\u011bhotenstv\u00ed nebo mate\u0159stv\u00ed<\/strong>,<\/li>\n<li>jestli\u017ee to je nutn\u00e9 podle l\u00e9ka\u0159sk\u00e9ho posudku vydan\u00e9ho poskytovatelem pracovn\u011bl\u00e9ka\u0159sk\u00fdch slu\u017eeb nebo rozhodnut\u00ed p\u0159\u00edslu\u0161n\u00e9ho org\u00e1nu ochrany ve\u0159ejn\u00e9ho zdrav\u00ed <strong>v z\u00e1jmu ochrany zdrav\u00ed jin\u00fdch fyzick\u00fdch osob p\u0159ed infek\u010dn\u00edm onemocn\u011bn\u00edm<\/strong>,<\/li>\n<li>jestli\u017ee je toho t\u0159eba podle pravomocn\u00e9ho rozhodnut\u00ed soudu nebo spr\u00e1vn\u00edho \u00fa\u0159adu, jin\u00e9ho st\u00e1tn\u00edho org\u00e1nu nebo org\u00e1nu \u00fazemn\u00edho samospr\u00e1vn\u00e9ho celku,<\/li>\n<li><strong>je-li zam\u011bstnanec pracuj\u00edc\u00ed v noci<\/strong> na z\u00e1klad\u011b l\u00e9ka\u0159sk\u00e9ho posudku vydan\u00e9ho poskytovatelem pracovn\u011bl\u00e9ka\u0159sk\u00fdch slu\u017eeb <strong>uzn\u00e1n nezp\u016fsobil\u00fdm pro no\u010dn\u00ed pr\u00e1ci, po\u017e\u00e1d\u00e1-li o to t\u011bhotn\u00e1 zam\u011bstnankyn\u011b, zam\u011bstnankyn\u011b, kter\u00e1 koj\u00ed, nebo zam\u011bstnankyn\u011b-matka do konce dev\u00e1t\u00e9ho m\u011bs\u00edce po porodu, kter\u00e1 pracuje v noci<\/strong>.<\/li>\n<\/ol>\n<p>Zam\u011bstnavatel <strong>m\u016f\u017ee<\/strong> p\u0159ev\u00e9st zam\u011bstnance na jinou pr\u00e1ci,<\/p>\n<ol>\n<li>dal-li zam\u011bstnanci <strong>v\u00fdpov\u011b\u010f z d\u016fvod\u016f uveden\u00fdch v \u00a7 52 p\u00edsm. f) a g),<\/strong><\/li>\n<li>bylo-li proti zam\u011bstnanci zah\u00e1jeno <strong>trestn\u00ed \u0159\u00edzen\u00ed pro podez\u0159en\u00ed z \u00famysln\u00e9 trestn\u00e9 \u010dinnosti sp\u00e1chan\u00e9 p\u0159i pln\u011bn\u00ed pracovn\u00edch \u00fakol\u016f<\/strong> nebo v p\u0159\u00edm\u00e9 souvislosti s n\u00edm ke \u0161kod\u011b na majetku zam\u011bstnavatele, a to <strong>na dobu do pravomocn\u00e9ho skon\u010den\u00ed trestn\u00edho \u0159\u00edzen\u00ed<\/strong>,<\/li>\n<li><strong>pozbyl-li zam\u011bstnanec do\u010dasn\u011b p\u0159edpoklady stanoven\u00e9 zvl\u00e1\u0161tn\u00edmi pr\u00e1vn\u00edmi p\u0159edpisy pro v\u00fdkon sjednan\u00e9 pr\u00e1ce<\/strong>, av\u0161ak v tomto p\u0159\u00edpad\u011b <strong>nejd\u00e9le<\/strong> celkem <strong>na 30 pracovn\u00edch dn\u016f v kalend\u00e1\u0159n\u00edm roce<\/strong>.<a class=\"slideto\" href=\"#_ftn1\" name=\"_ftnref1\">[1]<\/a><\/li>\n<\/ol>\n<p><strong>TIP:<\/strong> P\u0159e\u010dt\u011bte si, jak na <a href=\"https:\/\/money.cz\/novinky-a-tipy\/mzdy-a-personalistika\/ukonceni-pracovniho-pomeru-neni-jen-tak-co-je-dobre-vedet\/\">ukon\u010den\u00ed pracovn\u00edho pom\u011bru v\u00fdpov\u011bd\u00ed<\/a>.<\/p>\n<p>P\u0159i p\u0159eveden\u00ed zam\u011bstnance na jinou pr\u00e1ci podle p\u0159edchoz\u00edch bod\u016f je zam\u011bstnavatel povinen p\u0159ihl\u00ed\u017eet k tomu, aby tato pr\u00e1ce byla pro n\u011bho vhodn\u00e1 vzhledem k jeho zdravotn\u00edmu stavu a schopnostem a pokud mo\u017eno i k jeho kvalifikaci.<\/p>\n<p>Mimo v\u00fd\u0161e uveden\u00e9 m\u016f\u017ee zam\u011bstnavatel p\u0159ev\u00e9st zam\u011bstnance <strong>i bez<\/strong> jeho <strong>souhlasu<\/strong> na dobu nezbytn\u00e9 pot\u0159eby na jinou pr\u00e1ci, ne\u017e byla sjedn\u00e1na, jestli\u017ee to je t\u0159eba k <strong>odvr\u00e1cen\u00ed mimo\u0159\u00e1dn\u00e9 ud\u00e1losti, \u017eiveln\u00ed ud\u00e1losti nebo jin\u00e9 hroz\u00edc\u00ed nehody nebo k zm\u00edrn\u011bn\u00ed jejich bezprost\u0159edn\u00edch n\u00e1sledk\u016f, a to na nezbytn\u011b nutnou dobu<\/strong>.<\/p>\n<p>D\u016fvod p\u0159eveden\u00ed na jinou pr\u00e1ci a dobu, po kterou m\u00e1 p\u0159eveden\u00ed trvat je zam\u011bstnavatel povinen p\u0159edem projednat se zam\u011bstnancem; doch\u00e1z\u00ed-li p\u0159eveden\u00edm zam\u011bstnance ke zm\u011bn\u011b pracovn\u00ed smlouvy, je zam\u011bstnavatel povinen vydat mu p\u00edsemn\u00e9 potvrzen\u00ed o d\u016fvodu p\u0159eveden\u00ed na jinou pr\u00e1ci a dob\u011b jeho trv\u00e1n\u00ed, s v\u00fdjimkou p\u0159\u00edpad\u016f uveden\u00fdch v \u00a7 41 odstavci 2 p\u00edsm. c) a v odstavci 4.<\/p>\n<h3>Zm\u011bna pracovn\u00ed pom\u011bru p\u0159i jmenov\u00e1n\u00ed<\/h3>\n<p>Za zm\u011bnu pracovn\u00edho pom\u011bru se pova\u017euje tak\u00e9 jmenov\u00e1n\u00ed na vedouc\u00ed pracovn\u00ed m\u00edsto podle <a href=\"https:\/\/www.zakonyprolidi.cz\/cs\/2006-262?text=%C2%A7%2033\" target=\"_blank\" rel=\"noopener\">\u00a7 33 odst. 3<\/a>, k\u00a0n\u011bmu\u017e dojde po vzniku pracovn\u00edho pom\u011bru. Jedn\u00e1 se sice fakticky <strong>o jednostrannou zm\u011bnu druhu pr\u00e1ce ze strany zam\u011bstnavatele<\/strong>, nicm\u00e9n\u011b je logick\u00e9, \u017ee s n\u00ed mus\u00ed zam\u011bstnanec vyslovit souhlas.<\/p>\n<p>Je d\u016fle\u017eit\u00e9 si uv\u011bdomit, \u017ee po odvol\u00e1n\u00ed z\u00a0pracovn\u00edho m\u00edsta vedouc\u00edho nebo po vzd\u00e1n\u00ed se takov\u00e9ho m\u00edsta se <strong>zam\u011bstnanec automaticky ze z\u00e1kona nenavrac\u00ed na p\u016fvodn\u011b sjednan\u00e9 m\u00edsto<\/strong>. Ze z\u00e1kona v\u0161ak vypl\u00fdv\u00e1, \u017ee <strong>pracovn\u00ed pom\u011br nekon\u010d\u00ed, tud\u00ed\u017e<\/strong> mu zam\u011bstnavatel mus\u00ed <strong>nab\u00eddnout jinou vhodnou pr\u00e1ci<\/strong> odpov\u00eddaj\u00edc\u00ed jeho kvalifikaci \u010di p\u0159\u00edpadn\u011b jeho zdravotn\u00edmu stavu, ale <strong>p\u016fvodn\u00ed m\u00edsto mu dr\u017eet nemus\u00ed<\/strong>.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-large wp-image-6780\" src=\"https:\/\/money.cz\/novinky-a-tipy\/wp-content\/uploads\/2021\/11\/pexels-sora-shimazaki-5673489-1024x491.jpg\" alt=\"\" width=\"1024\" height=\"491\" \/><\/p>\n<h2>Zm\u011bna pracovn\u00edho za\u0159azen\u00ed se souhlasem zam\u011bstnance<\/h2>\n<h3>P\u0159eveden\u00ed na jinou pr\u00e1ci pro prostoj nebo pro p\u0159eru\u0161en\u00ed pr\u00e1ce zp\u016fsoben\u00e9 nep\u0159\u00edzniv\u00fdmi pov\u011btrnostn\u00edmi vlivy<\/h3>\n<p>Nem\u016f\u017ee-li zam\u011bstnanec konat pr\u00e1ci pro prostoj nebo pro p\u0159eru\u0161en\u00ed pr\u00e1ce zp\u016fsoben\u00e9 nep\u0159\u00edzniv\u00fdmi pov\u011btrnostn\u00edmi vlivy, m\u016f\u017ee ho zam\u011bstnavatel p\u0159ev\u00e9st na jinou pr\u00e1ci, ne\u017e byla sjedn\u00e1na v pracovn\u00ed smlouv\u011b, jen v p\u0159\u00edpad\u011b, \u017ee zam\u011bstnanec s p\u0159eveden\u00edm souhlas\u00ed. Pokud zam\u011bstnanec ale s\u00a0p\u0159eveden\u00edm souhlasit nebude, tak se v\u00a0t\u011bchto p\u0159\u00edpadech bude jednat o tzv. <strong>p\u0159ek\u00e1\u017eku na stran\u011b zam\u011bstnavatele.<\/strong><\/p>\n<h3>Pracovn\u00ed cesta zam\u011bstnance<\/h3>\n<p>Problematika pracovn\u00ed cesty je upravena v <a href=\"https:\/\/www.zakonyprolidi.cz\/cs\/2006-262?text=%C2%A7%2042\" target=\"_blank\" rel=\"noopener\">\u00a7 42 ZP<\/a>. Jedn\u00e1 se o \u010dasov\u011b omezen\u00e9 vysl\u00e1n\u00ed zam\u011bstnance zam\u011bstnavatelem k v\u00fdkonu pr\u00e1ce <strong>mimo sjednan\u00e9 m\u00edsto v\u00fdkonu pr\u00e1ce<\/strong>. Zam\u011bstnavatel m\u016f\u017ee vyslat zam\u011bstnance na dobu nezbytn\u00e9 pot\u0159eby na pracovn\u00ed cestu jen na z\u00e1klad\u011b dohody s n\u00edm. Tuto dohodu je obecn\u011b vhodn\u00e9 zakomponovat rovnou do pracovn\u00ed smlouvy, vyhnete se tak dal\u0161\u00edmu pap\u00edrov\u00e1n\u00ed.<\/p>\n<p>Dle <a href=\"https:\/\/www.zakonyprolidi.cz\/cs\/2006-262?text=%C2%A7%20240\" target=\"_blank\" rel=\"noopener\">\u00a7 240 ZP<\/a> souhlas zam\u011bstnance s\u00a0vysl\u00e1n\u00edm na pracovn\u00ed cestu zam\u011bstnavatel pot\u0159ebuje i\u00a0v p\u0159\u00edpad\u011b pracovn\u00ed cesty mimo obvod obce pracovi\u0161t\u011b nebo bydli\u0161t\u011b t\u011bhotn\u00e9 zam\u011bstnankyn\u011b, zam\u011bstnankyn\u011b a zam\u011bstnance pe\u010duj\u00edc\u00edch o\u00a0d\u011bti do 8 let v\u011bku, osam\u011bl\u00e9 zam\u011bstnankyn\u011b nebo osam\u011bl\u00e9ho zam\u011bstnance pe\u010duj\u00edc\u00edch o\u00a0d\u00edt\u011b mlad\u0161\u00ed ne\u017e 15 let, nebo zam\u011bstnance, kter\u00fd prok\u00e1\u017ee, \u017ee p\u0159ev\u00e1\u017en\u011b s\u00e1m dlouhodob\u011b pe\u010duje o\u00a0osobu, kter\u00e1 se podle zvl\u00e1\u0161tn\u00edho pr\u00e1vn\u00edho p\u0159edpisu pova\u017euje za osobu z\u00e1vislou na pomoci jin\u00e9 fyzick\u00e9 osoby ve stupni II (st\u0159edn\u011b t\u011b\u017ek\u00e1 z\u00e1vislost), ve stupni III (t\u011b\u017ek\u00e1 z\u00e1vislost) nebo stupni IV (\u00fapln\u00e1 z\u00e1vislost). <strong>V t\u011bchto p\u0159\u00edpadech nesta\u010d\u00ed, pokud byl souhlas obecn\u011b uveden v\u00a0pracovn\u00ed smlouv\u011b a zam\u011bstnavatel je povinen z\u00edskat souhlas pro ka\u017edou pracovn\u00ed cestu.<\/strong><\/p>\n<p>Zam\u011bstnanec pak na pracovn\u00ed cest\u011b kon\u00e1 pr\u00e1ci podle pokyn\u016f vedouc\u00edho zam\u011bstnance, kter\u00fd ho na pracovn\u00ed cestu vyslal.<\/p>\n<p>Samoz\u0159ejmost\u00ed je, \u017ee za pracovn\u00ed cestu <strong>n\u00e1le\u017e\u00ed zam\u011bstnanci cestovn\u00ed n\u00e1hrady<\/strong>, tj. n\u00e1hrada j\u00edzdn\u00edch v\u00fddaj\u016f, v\u00fddaj\u016f na ubytov\u00e1n\u00ed, zv\u00fd\u0161en\u00e9 stravovac\u00ed v\u00fddaje a d\u00e1le nutn\u00e9 vedlej\u0161\u00ed v\u00fddaje.<\/p>\n<p>Nutno podotknout, \u017ee na ur\u010dit\u00fdch pracovn\u00edch m\u00edstech je <strong>realizace pracovn\u00edch cest nezbytnou sou\u010d\u00e1st\u00ed sjednan\u00e9ho druhu pr\u00e1ce<\/strong> (nap\u0159. \u0159idi\u010d kamionov\u00e9 p\u0159epravy apod.). Odm\u00edtnut\u00ed souhlasu s\u00a0kon\u00e1n\u00edm pracovn\u00edch cest zam\u011bstnancem pak m\u016f\u017ee b\u00fdt zam\u011bstnavatelem kvalifikov\u00e1no jako nespl\u0148ov\u00e1n\u00ed po\u017eadavk\u016f pro v\u00fdkon sjednan\u00e9 pr\u00e1ce bez zavin\u011bn\u00ed zam\u011bstnavatele, a tud\u00ed\u017e d\u016fvodem k\u00a0v\u00fdpov\u011bdi ze strany zam\u011bstnavatele podle <a href=\"https:\/\/ppropo.mpsv.cz\/zakon_262_2006#p52\" target=\"_blank\" rel=\"noopener\">\u00a7 52 p\u00edsm. f)<\/a> z\u00e1kon\u00edku pr\u00e1ce.<\/p>\n<h3>P\u0159elo\u017een\u00ed zam\u011bstnance<\/h3>\n<p>P\u0159elo\u017een\u00ed znamen\u00e1 do\u010dasnou zm\u011bnu m\u00edsta v\u00fdkonu pr\u00e1ce sjednan\u00e9ho v\u00a0pracovn\u00ed smlouv\u011b. P\u0159elo\u017eit zam\u011bstnance k\u00a0v\u00fdkonu pr\u00e1ce do jin\u00e9ho m\u00edsta, ne\u017e bylo sjedn\u00e1no v\u00a0pracovn\u00ed smlouv\u011b, lze pouze s\u00a0jeho souhlasem a v\u00a0r\u00e1mci zam\u011bstnavatele, pokud to nezbytn\u011b vy\u017eaduje jeho provozn\u00ed pot\u0159eba. Po dobu do\u010dasn\u00e9ho p\u0159id\u011blen\u00ed v\u0161ak zam\u011bstnanci pracovn\u00ed \u00fakoly fakticky p\u0159id\u011bluje p\u0159ej\u00edmaj\u00edc\u00ed zam\u011bstnavatel.<\/p>\n<p>Do\u010dasn\u011b p\u0159id\u011blit lze zam\u011bstnance <strong>jen na z\u00e1klad\u011b dohody mezi zam\u011bstnancem a kmenov\u00fdm zam\u011bstnavatelem<\/strong>. Tato dohoda sm\u00ed b\u00fdt uzav\u0159ena <strong>nejd\u0159\u00edve po uplynut\u00ed 6 m\u011bs\u00edc\u016f ode dne <\/strong><a href=\"https:\/\/money.cz\/novinky-a-tipy\/mzdy-a-personalistika\/zalozeni-a-vznik-pracovniho-pomeru-jak-zbytecne-nechybovat\/\">vzniku pracovn\u00edho pom\u011bru<\/a>. Tato podm\u00ednka m\u00e1 za c\u00edl zamezit p\u0159\u00edpad\u016fm, kdy by byl zam\u011bstnanec p\u0159ij\u00edm\u00e1n do pracovn\u00edho pom\u011bru za \u00fa\u010delem jeho okam\u017eit\u00e9ho p\u0159id\u011blen\u00ed k\u00a0jin\u00e9mu zam\u011bstnavateli \u2013 k\u00a0tomuto typu zam\u011bstn\u00e1v\u00e1n\u00ed maj\u00ed b\u00fdt p\u0159\u00edslu\u0161n\u00e9 jen agentury pr\u00e1ce.<\/p>\n<h3>Dodatek k pracovn\u00ed smlouv\u011b p\u0159i zm\u011bn\u011b pracovn\u00edho pozice<\/h3>\n<p>Dohoda mezi zam\u011bstnancem a kmenov\u00fdm zam\u011bstnavatelem mus\u00ed obsahovat p\u0159inejmen\u0161\u00edm n\u00e1zev (jm\u00e9no a p\u0159\u00edjmen\u00ed) p\u0159ej\u00edmaj\u00edc\u00edho zam\u011bstnavatele, den vzniku do\u010dasn\u00e9ho p\u0159id\u011blen\u00ed, druh a m\u00edsto v\u00fdkonu pr\u00e1ce a doba, na kterou se do\u010dasn\u00e9 p\u0159id\u011blen\u00ed sjedn\u00e1v\u00e1. Dohoda mus\u00ed b\u00fdt uzav\u0159ena p\u00edsemn\u011b. Obvykle se sjedn\u00e1v\u00e1 jako dodatek k <a href=\"https:\/\/money.cz\/novinky-a-tipy\/mzdy-a-personalistika\/zalozeni-a-vznik-pracovniho-pomeru-jak-zbytecne-nechybovat\/\">pracovn\u00ed smlouv\u011b<\/a>. Dohoda m\u016f\u017ee krom\u011b toho obsahovat i\u00a0sjedn\u00e1n\u00ed pravideln\u00e9ho pracovi\u0161t\u011b pro \u00fa\u010dely cestovn\u00edch n\u00e1hrad.<\/p>\n<p>Do\u010dasn\u00e9 p\u0159id\u011blen\u00ed se realizuje na z\u00e1klad\u011b smlouvy mezi kmenov\u00fdm a p\u0159ej\u00edmaj\u00edc\u00edm zam\u011bstnavatelem. Tato smlouva nen\u00ed z\u00e1kon\u00edkem pr\u00e1ce upravena a \u0159\u00edd\u00ed se ob\u010dansk\u00fdm z\u00e1kon\u00edkem.
